Federal judge skeptical of effort to block Musk's DOGE from accessing data, firing employees [Chutkan]

Judge Tanya Chutkan says she will issue a ruling within 24 hours

A federal judge expressed skepticism of efforts seeking to bar President Donald Trump's administration from accessing federal data and firing federal workers when hearing remarks from the bench on Monday.

Judge Tanya Chutkan has yet to issue a ruling in the case, which relates to billionaire Elon Musk and the Department of Government Efficiency (DOGE) and their efforts to curb government spending. Chutkan says she will rule on the case within 24 hours.

At issue in the case are DOGE's actions within seven federal agencies, including the Office of Personnel Management, the Department of Education, Department of Labor, The Department of Health and Human Services, Department of Energy, Department of Transportation and the Department of Commerce.

Attorneys general from 14 states argue Musk and Trump's administration have engaged in illegal executive overreach, but Chutkan says she wasn't convinced so far.

"There is no greater threat to democracy than the accumulation of state power in the hands of a single, unelected individual," the lawsuit brought against DOGE states.

Chutkan says lawyers for the states have yet to establish that there is imminent harm that could be avoided by restraining DOGE.

"The things that I’m hearing are serious and troubling indeed… But you’re saying these are things that we’re hearing," she said. "I’m not seeing it so far."

If Chutkan is saying she's not sure, she's just talking herself into some cockamamie rationale to justify, however ridiculously, her ruling to do the evil thing.

Could it be Chukan wants to keep her job?

She is already in the cross hairs for her dispicable actions toward January 6 patriots!

Removing a federal judge requires 1/2 House to impeach & 2/3 Senate to remove. None of the TDS judges will be removed by Congress. Our best hope is that there decisions be overturned by a higher court. Sadly, our highest court, the SCOTUS, cannot be relied on to do the right thing. Remember that when cases of 2020 voter fraud were brought to the SCOTUS, they would not take the cases. Still, pray that these TDS judges be overturned.

I can see it now: DOGE is fine for it to exist under the executive branch because it’s a obviously a fee ... but it can’t do audits because it’s actually not a fee it’s a tax and taxation needs legislative approval.

This is why the fed judiciary is the least democratic - and hence most dangerous - branch of government. They have life tenure so voters get no say (the only branch to be so privileged), as a practical matter they cannot be removed, and they have the power to issue decrees that in effect amend the constitution with the vote of just one person - themselves - and as a practical matter cannot be overruled because passing an actual amendment to fix their overreach is basically impossible now.

Jefferson knew all this 250 years ago:
"You seem to consider the judges as the ultimate arbiters of all constitutional questions; a very dangerous doctrine indeed, and one which would place us under the despotism of an oligarchy. Our judges are as honest as other men, and not more so. They have, with others, the same passions for party, for power, and the privilege of their corps.... You’re right. At least with the impeachment process the compromised congressmen will be identified as well, along with public outing of a corrupt Soros judge.

Exactly, the rats somehow got the most important lawfare case in front of the worst of the Trump hating DC judges. The judge shopping that has gone here has been brazen and obvious. I think she got the word make it look good. I’m betting in the end the rat AG’s get exactly what they want from her.
