Trump Seeks Emergency SCOTUS Stay Of District Court TRO Preventing Termination of Senior Employee District Court prevented termination of Hampton Dellinger as head of the Office of Special Counsel. Emergency Application: “The United States now seeks this Court’s intervention because these judicial rulings irreparably harm the Presidency by curtailing the President’s ability to manage the Executive Branch in the earliest days of his Administration….”

I’ve been arguing since the Democrats’ pre-planned lawfare campaign started that the Trump administration needed to start getting cases to the Supreme Court because what was happening in the district courts were emergency Temporary Restraining Orders which impigned on executive branch authority.

Looks like we have the first case where SCOTUS may weigh in.

The case was brought by Hampton Dellinger, Special Counsel to the DOJ Office of Special Counsel, seeking to have him restored to the position after termination by the Trump administration. The district court in DC granted the TRO, and the DOJ took the case to the DC Circuit Court of Appeals, which refused to consider it on the ground that TROs generally are not appealable.

If SCOTUS wants to save themselves a lot of time and trouble for this term, they could smack down the deep state, and state unequivocably that per the Constitution the President has control over the Executive Branch of government and can hire or fire employees at will.

Let's see if Roberts has the cojones to do so. SCOTUS just Friday added an Opinion day to their calendar for next Friday. The 21st would be a good day as any to release such an Opinion.

POTUS has to have that right. Otherwise elections don’t matter. “Democracy” is dead. We are a country of, by and for the administrators.

Trump gave him the chance of a buyout and evidently it was declined.

Now he has no recourse.

Thanks for the link to the earlier thread. I note that CBS didn’t link to Trump’s petition nor quote the actual language from the lower court’s ruling or the dissent. The article’s author simply passed on the deep state’s view of the issue and subtlety encouraged their readers to be outraged at Trump’s actions.

Trump moved at a speed they are unaccustomed to. They normally have plenty of Bleach Bit, and hammer time, while they move bribes into offshore accounts. They got caught flat footed.

Hopefully this employee is under investigation. By staying in and not resigning, the employee would incur significant legal expenses without being allowed to resume job duties. This type of thing happened to FBI whistleblowers that tried to rat out the criminals running the Biden FBI.
They can always find something on these people to justify an investigation. These district court judges are crazy, but they’ll have a lot more trouble blocking an investigation.

Trump has Emergency Stay options with the Supreme Court and with the specific Judges who write specific restraining orders against the Trump Administration.

If 2025 Trump is actually doing this, it is amazing good news.

In 2017 and 2025 (until today), Trump simply filed appeals against the Restraining Judges, which take months or years to work their way through the Court system.

By filing an Emergency Stay with the Supreme Court, Trump instantly gets his legal argument in front of voters.

The Supreme Court can vote NO on hearing the Emergency case.

I think four Justices need to vote YES to hear the case.

If Trump starts filing good faith Emergency Stay cases against ALL the Restraining Orders, we will know Trump is serious about effecting radical change in the federal government.

If this is just a one time smoke and mirrors PR stunt - like 2017 - we will know that Trump has never been serious about radical change.

Roberts will get his gal pals to support him in avoiding hearing the issue. Roberts wants the courts to have the power over the executive on all these issues.
