The Trump administration wants the Supreme Court to permit the firing of the head of the federal agency dedicated to protecting whistleblowers, according to documents obtained Sunday that would mark the first appeal to the justices since President Donald Trump took office.
The emergency appeal is the start of what probably will be a steady stream from lawyers for the Republican president and his administration seeking to undo lower court rulings that have slowed his second-term agenda.
The Justice Department's filing obtained by The Associated Press asks the conservative-majority court to lift a judge's court order temporarily reinstating Hampton Dellinger as the leader of the Office of Special Counsel.
Dellinger has argued that the law says he can only be dismissed for problems with the performance of his job, none of which were cited in the email dismissing him.
The petition came hours after a divided appeals court panel refused on procedural grounds to lift the order, which was filed Wednesday and expires on Feb. 26.
The case is not expected to be docketed until after the Supreme Court returns from the Presidents Day holiday weekend. The justices would not act until Tuesday at the earliest.
It's not clear what reception Trump will get from the conservative-dominated court that includes three justices he nominated in his first term.
The case began last week when Dellinger sued over his removal as head of the Office of Special Counsel, which is responsible for guarding the federal workforce from illegal personnel actions, such as retaliation for whistleblowing. He was appointed by Democratic President Joe Biden and confirmed by the Senate to a five-year term in 2024.

How dare he!!! Only the democrats are entitled to go to the Courts. Unelected officials have plenty authority!! They control, not some person selected an electorate.
That is not democracy.
Democracy is the Dems being in charge no matter what.
I worry about the integrity of our scotus and its solvency from corruption / influencings.
This concern is not mitigated by obvious court inactions regarding the 2020 election thefts.
Investigate the high court for graft.
Biden Nominates Hunter’s Burisma-Linked Associate as Special Counsel

Democrat President Joe Biden has nominated his son Hunter’s former business associate to serve as special counsel.
Biden nominated Hampton Dellinger who previously worked alongside Hunter while he served on the board of Ukrainian energy company Burisma Holdings....
I thought we wanted whistleblowers.
(a) There is established the Office of Special Counsel, which shall be headed by the Special Counsel. The Office shall have an official seal which shall be judicially noticed. The Office shall have its principal office in the District of Columbia and shall have field offices in other appropriate locations.
(b) The Special Counsel shall be appointed by the President, by and with the advice and consent of the Senate, for a term of 5 years. The Special Counsel may continue to serve beyond the expiration of the term until a successor is appointed and has qualified, except that the Special Counsel may not continue to serve for more than one year after the date on which the term of the Special Counsel would otherwise expire under this subsection. The Special Counsel shall be an attorney who, by demonstrated ability, background, training, or experience, is especially qualified to carry out the functions of the position. A Special Counsel appointed to fill a vacancy occurring before the end of a term of office of the Special Counsel’s predecessor serves for the remainder of the term. The Special Counsel may be removed by the President only for inefficiency, neglect of duty, or malfeasance in office. The Special Counsel may not hold another office or position in the Government of the United States, except as otherwise provided by law or at the direction of the President.
My guess is that President Trump will argue that Hampton Dellinger was neglectful when he was Assistant Attorney General for the Office of Legal Policy under Joe Biden, given what we now know from DOGE about the rampant corruption that has been occurring in our Treasury systems.
Trump will argue that he can't trust Dellinger in the role of Special Prosecutor because of his ties to the people who have been covering this up. Trump will argue that whistleblowers will be hesitant to come forward with Dellinger in charge of the office.

I don’t think you should qualify as a “whistleblower” when you were appointed by one or more suspects in a fraud, bribery and espionage case and have conflicts of interest.
Hmmm. Maybe it’s the thoughts I have from watching the movie about Robert Hanssen. I think there is more to this that just a termination. Methinks that Dellinger has buried baggage that can’t be revealed publically yet. To do so would burn others. It will be exposed to SCOTUS as the District Judge is not qualified and may be involved.
I know, I may be crazy. But, something doesn’t seem right for me.

Feb 2014 : () In a February 2014 email, Dellinger told Hunter it was “great to see [him] last week.”
He also asked whether Hunter would be attending an attorney lunch.
Hunter appeared to have a conflict but said he would be in the office the next day.
“I will be here tomorrow and be great to catch up,” Dellinger said.
March 2014 : (Hunter Biden and Dellinger attend private gathering ) Dellinger worked on Boies Schiller Flexner’s Crisis Management and Government Response team while Hunter Biden served as counsel at the firm.
The firm had represented Burisma, where Hunter Biden had served on its board of directors.
Burisma paid Hunter tens of thousands of dollars a month to sit on the board, despite having zero experience in the energy industry.
Emails on Hunter’s abandoned “Laptop from Hell” show he worked intimately with lawyers on the firm’s crisis management team.
The emails indicate that Hunter also attended a private gathering with Dellinger and other firm employees in March 2014.
March 2014 : () Communication from the [Hunter Biden] laptop also showed that William Isaacson, a Boies Schiller Flexner partner, in March 2014 organized a dinner for individuals on the firm’s Crisis Management and Government Response team.
