No, Trump Does Not Have to Abide by a Mythical 'Judicial Supremacy'

It’s an old story: When people are allowed to get their way for too long, when they’re never told “No!” they may get too big for their britches.

They may develop a sense of entitlement and even become narcissistic.

And proving that judges are no exception to this reality are a number of recent court “opinions” designed to scuttle President Trump’s agenda.

One disallows DOGE from scrutinizing Treasury Department data.

Another states that the Trump administration must unfreeze funding on grants and loans.

A different opinion puts a freeze on Trump’s buyout offer for federal employees.

And yet another ordered the administration to restore sexual devolutionary (on “gender” and “sex changes”) government web pages Trump’s team had rightly deleted. So Biden could create those pages but, somehow, the current president may not remove them. Yes, it’s insane.

There’s a little known reason, however, why the rogue judges in question could so confidently engage in such insane judicial overreach. To wit:

We long ago accepted the overreach known as “judicial supremacy.”

This brings us to the simple remedy. Trump could just paraphrase the paraphrase of Andrew Jackson and say, “The courts have made their decisions — now let the judges enforce them.”

Trump and Musk need to treat the Feral black robed stooges the same way Joe Pedo did. Tell them to go take a flying leap at a rolling donut. Their actions are a violation of the U.S. Constitution. They are NOT A LEGISTLATIVE BRANCH OF GOVERNMENT. Screw them. They’re all America haters and Trump haters anyway. Besides that, they didn’t run for office last November. If the bastards want to play, they need to be elected by the people.

Trump should respect the decisions of only one court:

The Supreme Court.

All the rest of these political lilliputian judges can go pound sand until they win at the Supreme Court level only.

Remember, too, federal and state officials take an oath to uphold the Constitution.

They do not take an oath to uphold judges’ opinions.

This means that if I’m a president or governor and a court issues a ruling I truly believe is unconstitutional, I have a duty to ignore it. Otherwise, I’m violating my oath.

“But what of rogue legislators or presidents?” some may ask. Well, what of rogue judges (who apparently are everywhere)?

The answer is the Founders’ one: No branch can intrude into the others’ spheres.. This doesn’t mean there aren’t checks and balances. If, for example, a president believes a law is unconstitutional and refuses to enforce it, or takes an allegedly unconstitutional executive action, Congress can try to remove him; it can also impeach and remove renegade judges.

As for House representatives themselves, the remedy is removal via the ballot box.

This is why they must run for re-election every two years: Since they’re meant to be the most powerful branch (e.g., spending bills must originate in the House, and only it can file impeachment charges), they’re placed closest to the people’s reach.

Power means nothing, though, if not exercised. If congressional and executive powers are outsourced, it then can reduce us to what we’ve become: a government of, by and for judicial oligarchs.

So, no, President Trump doesn’t have to obey blatantly unconstitutional court opinions

I’m sure DOGE is marching on.
Also sure they downloaded everything the first night. Now it’s a matter of going over it. So the judicial order is too late.

The shadow gubmint which is the Deep State has blurred the lines been the separation of powers spelled out in the Constitution.

Until Trump came along, uniparty Presidents deferred to the Deep State.

Well, Trump’s first term was more of a struggle to fend off Deep State’s attacks and stay in office.

Obviously, a coup prevented him from serving his second term to which he was duly elected.

But an unbelievable “to big to rig” popular majority has allowed him to take office firing on all cylinders.

Trump is simply reestablishing the lines that were drawn constitutionally between the three branches.

The constitution prevents a dictatorship.

But Trump can dictate pretty much anything he pleases within the branch that he has ABSOLUTE power over.

If the three branches are truly co-equal, then the judiciary cannot order the executive to do or not do something. Especially if it is entirely within the powers of the Executive branch.

The judiciary has no independent mechanism to compel compliance. Lower-level officials may face legal consequences (e.g., contempt charges), but the president himself is more insulated due to executive privilege and political considerations. And, the President retains the power of pardons.

Dershowitz may be a liberal, but he’s intellectually honest. The Judiciary has been allowed to be the final say for so long that they believe themselves to be THE final word on everything.

He should acknowledge the lower court stay, then ignore it saying he will abide by the SCOTUS ruling ( if they get to it ).

where is Trump’s attorney general. Pam Bondi ??? She is the absolute weakest link in Trump’s 2nd administration!!! Other than her looks, why in the world did Trump not realize that the fact that her confirmation went so smoothly with the demoncrats, that she was the absolute wrong choice. Trump et al should have fought like crazy for Matt Gaetz.

i found this comment which makes my point:

“I hope the Trump administration is taking this time to work on something that will forever settle this problem of judges who think they are kings; but right now the judges are winning since the Executive Branch is bowing to their insane pronouncements.

“After the first insane proclamation, I would have rather seen an announcement by the attorney general that the Executive Branch is not going to follow this unconstitutional ruling of a rouge judge and Democrat donor; no laws are involved in the judges pronouncement, the item forbidden is internal to the Executive Branch and therefore not subject to judicial or legislative review.There are other relevant factors to mention.”

These insane proclamations are made to delay and hopefully stop and cripple the Trump administration. They will continue and increase until they are forcefully stopped and the judges pay a price.”
