Man re-arrested for random punch of stranger who spent 7 years in coma now that victim has died

A man who served six months in jail for sucker-punching a Brooklyn fruit stand manager in June 2017, leaving him in a coma, was charged with manslaughter Wednesday — nearly a year after the victim succumbed to his injuries, police said.

Gary Anderson is facing fresh manslaughter and criminally negligent homicide charges for clocking 38-year-old father and husband Domingo Tapia in the face.

The victim was riding his bike along Fulton St. in Bedford-Stuyvesant when he was punched off his ride near Albany Ave. on his way home from work.

Anderson, now 34, hit Tapia at random in a fit of anger after storming away from a quarrel with three men. He had a job teaching sports to kids at a YMCA at the time.

“I want justice. Whatever time he (already) served in jail is not enough for Domingo’s life. He eventually died,” the victim’s widow Esther Diaz told the Daily News Wednesday.

Tapia suffered a fractured skull and spent seven years in a coma following the unprovoked attack. He died last March.

Police initially believed Tapia was the victim of a hit-and-run driver. But a video viewed later by cops captured the shocking assault.

Cops arrested Anderson shortly after the attack. He took a  plea deal and was convicted of felony assault. He was sentenced to three years in prison with the agreement he could face manslaughter charges if the attack proved fatal down the road, a law enforcement source said.

Authorities said he was back on the street six months later.

“He should get the maximum,” Diaz said of the new charges and the sentence they could bring. “It does not matter for how many years he goes to jail, it’s not going to bring my husband back.

Typically a victim must die from the injuries within a year. Maybe NY is different?

It should be second degree, because he simply didn’t care about the consequences of his actions.

The victim died in relation to the offense. I think that is making the difference. They can trace straight path between the death and the original offense.

One year was the rule in New York when I lived there. Of course people did not often live in a comma for seven years in the day.

I think they could easily tag him with second-degree murder, and potentially even first to degree murder if it shows that he planned ahead of time to punch this guy

If the death can be directly correlated to the offense, the charge can always be upgraded. If I hypothetically poison somebody with a delayed action poison dart, the initial shooting with the dart is an assault. If they die, even years later, as a direct result of the poison, I become a murderer when they do.

The prosecutions medical experts are going to have to show that the death resulted from the injuries sustained in the original assault.

When a prosecutor lowballs and offense, it’s because he wants to increase the odds of conviction. Going too big carries the risk of the case being dismissed because he went with a charge that he could not substantiate.

Those attacks were called “Polar bear hunting” when the victim was a white guy, and “the knockout game” when it was a woman or non-white victim . In this case, it sounds like the victim was Hispanic, so I guess “knockout game”. As for the perp, yes Boo Boo, it’s them... again.

Since it’s not possible to know what a person is thinking, it would be REALLY GOOD to just assume that any interracial violent crime is a Hate Crime, at least for statistics.

...and they Musk makes sure that the ENTIRE COUNTRY understands just who is perpetrating the Hate Crimes.
