President-elect Donald Trump, in his first post-election TV interview, promised a confrontational return to the White House, saying he would like to see many of those who investigated him jailed, including lawmakers who led an inquiry into his role in the Jan. 6, 2021, attack on the Capitol.

In a 45-minute interview with NBC News’s “Meet the Press” that aired Sunday and was recorded on Friday, Trump said members of the now-defunct House select committee tasked with investigating the deadly Jan. 6, 2021, insurrection at the Capitol should be in jail.
“Everybody on that committee … for what they did, yeah, honestly, they should go to jail,” Trump said, including former congresswoman Liz Cheney (R-Wyoming), the top Republican on the Jan. 6 panel.
The committee, which shuttered when Republicans took back the House in January 2023, consisted of seven Democrats and two Republicans: Cheney and Adam Kinzinger (Illinois). The panel was chaired by Rep. Bennie G. Thompson (D-Mississippi).
The committee concluded that Trump actively inspired his supporters to commit violence in his name as he attempted to remain in office despite losing the 2020 election. News outlets, including The Washington Post, have said that Biden is considering preemptive pardons for individuals he and his team believe might face legal threats from the incoming Trump administration.
Trump’s comments on “Meet the Press” mark an escalation of his threats to members of the committee. While he posted in March 2023 that the committee members “should be prosecuted for their lies,” accusing them of “treason,” he has largely refrained from calling for their imprisonment.
He has only repeatedly expressed interest in jailing Cheney — a longtime Republican who lost her seat in Congress after refusing to excuse Trump’s efforts to overturn the results of the 2020 election.

Trump will force Biden into issuing a pardon tp the committee members and to many others. This will serve as his justification for his J6 pardons.
Everyone on the January 6th committee should be in prison until all the evidence they collected is turned over. Then they can go on trial.
He’s forcing Bidet to issue blanket pardons, so these folks can be required to answer truthful in any future investigation. No 5A protections with the pardons.

Members of Congress aren't eligible for pardons for official acts undertaken while in session.
I know that people say that the pardon power is unlimited, but there is the exception for the case of impeachment. Impeachment is a Congressional act regarding the President, so pardoning an act of Congress would violate separation of powers.
Furthermore, pardons are limited to "offenses against the United States," in other words, for breaking federal law. Members of Congress are held to a higher Constitutional standard.
Article I Section 6 Clause 2 says:
They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.
Adam Schiff's behavior on the House Judiciary Committee (submitting a memo full of lies to counter the Devon Nunes memo) and his involvement on the January 6th Select Committee are covered by the "speech and debate" clause of the Constitution. Liz Cheney's work on the same January 6th Select Committee is likewise covered by the "speech and debate" clause. A pardon would be "questioning" their official Congressional behavior.
It seems to me that a Presidential pardon of Schiff and Cheney would violate the "speech and debate" clause of the Constitution and is therefore unconstitutional.
A pardon can overturn a violation of federal law, but it cannot overrule the Constitution, which is supreme Law of the Land. They are already constitutionally immune for official acts when in Congress, so a pardon can't apply to them. Only private acts undertaken outside of Congress would be eligible for a pardon for Schiff and Cheney, or any other member of the J6 Committee.

If there is no crime there can be no pardon. So any pardon would have to state the crimes committed. But, with no conviction ….
