Elderly Georgia homeowner forced out of his house, arrested after alleged fraudster claimed ownership: ‘Made us feel like squatters’

An elderly Georgia homeowner was forced out of his house and arrested when an alleged swindler used fraudulent documents to claim ownership of the property.

Charles and Charmaine Allman lived in the same Stone Mountain, Ga. home — located 16 miles east of Atlanta — for the last two decades before officials told the couple Tuesday that they no longer owned the house and had to vacate.

“They made us feel like we were squatters,” Charmaine Allman told WSB-TV. “Just tossed my stuff out like it was trash.”

Most cops are just clerks with guns, they do the bare minimum at best. Their standard answer is, “this is a civil matter”, you must address it in the courts.
Demand a Sargeant and a detective be called.

I rented a shop for my equipment repair, the landlord illegally entered the space and remove $20,000 worth of tools and equipment. His reasoning was that the space, in his opinion, was messy and he sent pictures. The real reason was he was a thief.

When I called the police, the officer said it was a civil matter, nothing he could do, I had to sue him. When the dective arrived and I showed him the pictures and email from the landlord he told the cop this what they meant in his training when they explained “breaking & entering”.

He told the landlord, return what you stole and maybe he will not press charges. I he does press charges you are going to jail.

Everything was returned and I move out shortly after.

The laws need to be changed. GA is about to end this globalist and communist tactic. We are watching Kemp.

It is a communist attack on property rights. They have purposely made less and less able to afford a home. Blackrock and others are buying up homes. They really are trying to end home ownership. It’s all a plan.

I was a notary as part of my job.

All we affirm is the identification of the person signing the document, not the validity of the document.

We are not attorneys.

At 77, A life sentence for Murder isn’t very long, and at my age I will gladly accept the consequences if this happened to me.

That is a notary’s absolute number one priority. If a notary fails to do that, their authority should be revoked.

No. That's not what Notary's do. They are supposed to check the ID of the person signing the document as proof that they are who they say they are and not signing under duress. But Notary’s don’t have investigative authority to research, for example whether they are the rightful homeowner.

What does a Notary do?

A Notary's duty is to screen the signers of important documents for their true identity, their willingness to sign without duress or intimidation, and their awareness of the contents of the document or transaction. Some notarizations also require the Notary to put the signer under an oath, declaring under penalty of perjury that the information contained in a document is true and correct. Property deeds, wills and powers of attorney are examples of documents that commonly require a Notary.

Thank you. I was a notary for several years because of my job. Not attorneys and have no investigative authority other than seeing a legal form of ID as proof that the person signing the document is who they say they are, assuming the ID is not fraudulent.

The democrats have no interest in stopping this because they hate private property and ultimately will confiscate all of it when they can, and because they want the “oppressed” underclass to take whatever it wants from their “oppressors”.

There is a lot more to this story than the media is reporting. A quick interweb search on Duck Duck Go reveals that a Charles and Charmaine Allman in the Northern District of Georgia (which includes Atlanta and DeCalb County) filed Chapter 13 bankruptcy in July of 2022. Most Chapter 13 bankruptcies are filed to block pending foreclosures for unpaid mortgages.

Is this the same Charles and Charmaine Allman or is there another couple with the same names in Northern Georgia? If this is the same couple, was their house posted for foreclosure prior to the bankruptcy? Are they still making payments under their Chapter 13 plan or have they defaulted? Did a lender actually foreclose, either before or after they filed? Did a scammer pick them as victims because they had their house posted for foreclosure or because they were bankrupt? What happened to the guy who claims to have purchased the house in foreclosure? Has he been charged with a crime? Are the criminal charges against Charles Allman still pending? Were Charles and Charmain Allman evicted in court?

There are lots of unanswered questions, most of which could be answered by a competent reporter checking public records. Instead, they all keep copying and reporting the same story, which was apparently first published by WSBTV in Atlanta, and which reads like it was based entirely from talking with Charmaine Allman. The report says that a TV crew showed up at the house of the purported buyer and he told them to leave. If a TV showed up unannounced at my house I would tell them to leave too.

Never trust the media to tell the real story.

I don’t understand why the rightful homeowners don’t show up armed to the teeth and escort the squatters out with a barrel to their heads.
Then, lock the doors,and deny anything ever occurred.


Most people today expect the police to solve all of their problems, especially women. Most people don't have weapons, or are afraid to display them for fear of being charged with something. Everyone has a cell phone to take videos now, and the cops don't like people "taking the law into their own hands" because it threatens their authority.

Unfortunately his hands are tied by current laws on landlord-tenant disputes. He is also not an expert on determining whether documents are legit. It should have been immediately put before the local D.A.

At the very least when there is a dispute over ownership and there are conflicting documents or, other evidence, an order to vacate within 48 hours should be issued.

Every notarized document I have read has either that the notary saw I.D. or the party was personally known to them. So this to means the notary is in on it.

That is just one condition. A key feature of adverse possession is NOT HAVING THE OWNER’S PERMISSION TO USE THE PROPERTY. Fraudulent documents reading that you have a right to the property implies permission so this is not a case of “squatter’s rights” AKA adverse possession.

I wonder if besides the possibility of a foreclosure sale whether the property was sold by the county for failure to pay property taxes.

I have my original deed in my safe at home. It’s paid for and if something were wrong, the first thing I’d notice is the tax valuations and assessments and bills wouldn’t be coming to the same address.
