According to New York state law, squatters are “classified as tenants and receive temporary rights as such” after occupying a property for 30 days.
New York State law dictates that if an owner wants to reclaim property from a squatter after 30 days, they must prove a right to the property and proceed with legal eviction proceedings.
The Landas are taking Flores to landlord-tenant court to evict him. But it’s been a long process. ABC 7 reported that the couple already had five hearings in civil court but the process has been repeatedly delayed.

The police can’t arrest people unless there’s a law behind the arrest.
For some insane reason these squatters are being treated as if they were none paying tenants. That’s not the case. It would have made more sense to treat them as buglers.
Best thing to do is WRITE NEW LAW COVERING SQUATTERS SO THE POLICE CAN ARREST AND REMOVE THESE PEOPLE. UNTIL THEN THEY’LL BE TREATED AS NON PAYING RENTERS - WHICH IS NUTS.
Or Commiefornia, for that matter.
I read the other day that a landlord had a renter who was way behind on the rent and he was having trouble evicting them so he just moved into the house with them. After a short while they left. I thought that was an interesting approach.

If you rent an AirBnB for 30 or more days, the guest becomes a tenant. He can stop paying rent and you need to go through the eviction process.
Or if you have a house-sitter for 30 or more days. Or even a non-paying guest.
Not likely to happen.
Lawyers and Judges can afford to have someone watch their property while they are away or live non gated communities with security.
Normal people usually can’t afford such luxuries.
If I remember correctly in NY a squatter gains right if they occupy the property at least 10 days without complaint.
If you are going to gone more than a few days without someone in your house get your neighbors to watch your property. Let the local Law Enforcement know you are going to be gone. Maybe talk to your mail carrier personally to ask that they watch your home.
If I remember right in my state Squatter’s rights took two years to kick in. Two weeks is way too short. NY is just stupid and unjust to property owners. NY is way too generous to thieves.
How does a non-paying guest document they have been there long enough?
I suppose they can offer their testimony. That’s evidence. There might be other eyewitnesses, who would offer their testimony.
someone told me once that if you live out of town a bit a squatters rights only extend as far as the boom on a backhoe. wasn’t sure at the time what to make of that.
You also can’t cut off the power and water to try and make them leave, cause don’t you know they have rights.

All patriots in the country need to come to the rescue of oppressed NY property owners.
More specifically, all patriots need to support hopeful Trump 47 with a new patriot Congress that will support him to not only finish draining the swamp, but will also do its constitutionally enumerated duty to guarantee each state a republican form of government.
"Article IV, Section 4: The United States shall guarantee to every State in this Union a Republican Form of Government [emphasis added], and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence."
Trump-supporting Democratic and Republican patriots need to rescue NY property owners by IMMEDIATELY primarying all incumbent state and federal incumbent lawmakers and executives up for reelection this year, except for MTG, Gaetz & Company (and others?).
After all, election after election, career lawmakers are repeatedly showing that they don't have the leadership skills and patriotism to find legislative remedies for corrupt, unconstitutionally big state and federal governments.

Patriots then need to replace worthless, Trump-hating incumbent lawmakers with Trump-supporting patriot lawmakers in November so that hopeful Trump 47 will not be a lame duck president from the first day of his second term in office.
