When the federal government has abandoned its Constitutional duties, any state can secede. No Constitution means no country.

“Descending from these general principles, we find the proposition that in legal contemplation the Union is perpetual confirmed by the history of the Union itself. The Union is much older than the Constitution. It was formed, in fact, by the Articles of Association in 1774. It was matured and continued by the Declaration of Independence in 1776. It was further matured, and the faith of all the then thirteen States expressly plighted and engaged that it should be perpetual, by the Articles of Confederation in 1778. And finally, in 1787, one of the declared objects for ordaining and establishing the Constitution was “to form a more perfect Union.”

“But if destruction of the Union by one or by a part only of the States be lawfully possible, the Union is less perfect than before the Constitution, having lost the vital element of perpetuity.

“It follows from these views that no State upon its own mere motion can lawfully get out of the Union; that resolves and ordinances to that effect are legally void, and that acts of violence within any State or States against the authority of the United States are insurrectionary or revolutionary, according to circumstances.”

But consider Amendment X:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

In my opinion Amendment X voids the Articles of Confederation and the preamble of the Constitution for states that are parties to the Constitution.

Texas could file at the Supreme Court a petition for divorce from all other governmental parties to the Union on the grounds of irreconcilable differences.

the biggest mistake the original states made was not specifically stating the process for a state to leave the union.

The laws of England forbade the original colonies from forming their own nation, too, but when the colonies got good and fed up, they told King George to go piss off real good and quick, did they not?

Tell me how this is any different for Texas?

First,
Texas (unlike any other state) can divide itself into 5 states if so inclined.

Second,
As mentioned in the above article, a treaty was signed by the US senate with the Republic of Texas, that allows Texas to leave the Union. I will post that here when I find a link to the Treaty.

If you google, you will find a lot of recent lib posts on how Texas cannot do this or that, and it’s like every other state. But it’s not, it entered as it’s own country NOT a territory or possession of the US.

I think states can secede.

I also think (and know from past experience) the country can try to prevent it if it decides to.

The civil war showed both of my statements to be true.

The outcome, however isn’t automatically that they cannot. If the seceding side can win, they can and will secede.

Seems to be it’s more of an economic problem. There are lots of folks in Texas drawing Social Security if Texas succeeds then those monthly payments will stop. Texas is full of military installations if the state of Texas succeeds then US support for them will stop. I would hope the US would still support its Veterans with their checks but no doubt they would need to go to the US for their healthcare.

Geez if they succeed Social Security would be solvent for 100 years, the Defense budget would be reduced significantly, and they can let us Vets just die...

Texas is my favorite State besides Montana as I have spent years there but calls for Texas to succeed are just dumb...

Session is not mentioned in the Constitution. James Madison maintained to his dying day any state could peacefully secede. He also maintained any attempt by the federal government to use military force to prevent session would be an invasion and not within the power of a federal government.

She got a phone call. LOL. She has sufficiently prostrated herself publicly, apologized, denouncing herself in the latest struggle session, and agrees to be a liberal piñata, always striving to be the “good” Republican.

If she is the nominee she won’t be able to sustain the bombardment by the media once they turn on her

The media will turn on any republican

Trump is thick skin and can handle the media’s attacks
