The family of Jan. 6 protester Ashli Babbitt has filed a $30 million wrongful death lawsuit against the government, saying she posed no threat to anyone when she was killed.
Babbitt was fatally shot trying to enter a secured area inside the U.S. Capitol Building the day the Capitol riot took place three years ago. The 14-year Air Force veteran was unarmed at the time, as she tried to climb through a broken window in a door near the House Chamber.
The lawsuit, which was filed in federal court in Southern California, alleges that Babbitt was ambushed by Capitol Police Lt. Michael Byrd, who shot her.
“Ashli posed no threat to the safety of anyone,” the lawsuit reads.
In August of 2021, the Capitol Hill Police Department conducted an internal investigation and concluded that Byrd had violated no laws and would not be disciplined for the shooting.
“USCP officers had barricaded the Speaker’s Lobby with furniture before a rioter shattered the glass door,” the department said following the investigation, according to CBS News. “If the doors were breached, the rioters would have immediate access to the House chambers. The officer’s actions were consistent with the officer’s training and USCP policies and procedures.”
The lawsuit also accuses the Capitol Police of assault and negligent use of force.

Babbitt was perched in the door window frame. Then after having a brief comm, Byrd fires upon Babbitt. I don’t recall seeing Babbitt look towards Byrd in response to any possible command to “freeze”. And neither did Byrd appear to yell any such command. Is it normal to fire upon an apparent offender without uttering a word?
Also, curious timing of the filing with respect to the date.
I hope it took this long because they wanted to be sure it was all air-tight!
$30 million? Not enough to hurt. I also want the guy that shot her fired, fined and in prison for his remaining days.

We got shots shots fired in the lobby of the House chamber. Shots are being fired at us and we’re sh, uhh, prepared to fire back at them. We have guns drawn. Please don’t leave that end. Don’t leave that end. Approximately 35 seconds later, Lt. Byrd made another radio call, stating, “405B. We got an injured person. I believe that person was shot.” In fact, no shots were fired at Lt. Byrd or his fellow officers. The only shot fired was the single shot Lt. Byrd fired at Ashli. He heard the loud noise of the gunshot. He saw her fall backwards from the window frame.

Prayers up for the family. Unfortunately, it’s more than likely the the friggin’ jury will be made up of far left turd rollers around the country with stories how they were almost killed during the massacre at the Little Big Hole on Capistol Hill by those evil white guys without man-buns.
