Obama-appointed District Judge Tanya Chutkan paused former President Donald Trump’s 2020 election trial schedule while the appeal for his presidential immunity claim is pending.
In early December, Chutkan rejected Trump’s bid to have his case dismissed based on presidential immunity, prompting Trump to appeal to the D.C. Circuit Court of Appeals. Chutkan agreed Wednesday to pause pre-trial deadlines and further proceedings pending the appeals court’s decision.
“[T]he court agrees with both parties that Defendant’s appeal automatically stays any further proceedings that would move this case towards trial or impose additional burdens of litigation on Defendant,” Chutkan wrote Wednesday.
Special Counsel Jack Smith asked the Supreme Court to take up the question Monday before the D.C. Circuit reaches a decision. The Supreme Court agreed to expedite its consideration of his petition, asking Trump’s attorneys to weigh in by Dec. 20.
Chutkan said she would re-consider whether to maintain the March 4 trial date after the appeal is resolved. She noted that the pause does not strip her of jurisdiction to “enforce the measures it has already imposed to safeguard the integrity of these proceedings,” including the gag order imposed on the former president.
“If jurisdiction is returned to this court, it will—consistent with its duty to ensure both a speedy trial and fairness for all parties—consider at that time whether to retain or continue the dates of any still-future deadlines and proceedings, including the trial scheduled for March 4, 2024,” Chutkan wrote.
Uh oh!
good news.
They wouldn’t take this route unless they knew SCOTUS would quickly take the case and rule against Trump. Bad news, not good.
This is not a major victory, or any victory. It is an automatic stay. It happens automatically. This is routine.
Seems like a reasoned move on District Judge Tanya Chutkan’s
part.
Should this be pushed back to the appellate courts, it
stands to reason she may react the same way. Until the
issue is resolved, it’s a waste of time to allow the case
before her to continue.
Will she see it the same way? I would hope so. Not
holding my breath.
The involvement of the SCOTUS in the matter presented
by Jack Smith, now puts her case on hold, which she
may not have done at the appellate level, but now
going backwards, she may leave her stay in place. Would
hope so.
A major victory is a pause…
I suppose it would take a Miracle for all the lawfare to end without any legal consequences for Trump et al.
This is hardly a “major victory”. It’s a procedural scheduling matter.
Every instinct l have tells me Roberts is going to let that evil prick smith take Trump off the board. He waited until it looked like Trump has the nomination locked. The treasonous Justice who gave us Obongo care will tell himself he is doing it for the good of the country.
The 1st five post we have ‘the best thing ever’, ‘the worst thing that could happen’, and a ‘its routine/normal thing’.
I’ll come back later.
Right.
and this is the reason why Jack Smith requested the Supreme Court to intervene even before the appellate court has a chance to rule on some aspects of this.
The Jan/6 trial is automatically suspended until the immunity question is resolved, and Jack Smith can not hold the March 4 trial date (for maximum damage to Trump’s election) unless the Supreme court rules before the Appellate Court, something pretty unprecedented.

How is this a victory? She’s merely just formally delaying things while her “bosses” at the Supreme Court rule on an important philosophical/Constitutional argument underlying the prosecution of Trump
As a side note, Congress created the US Federal District Court - and they can eliminate it - especially as it has become merely the kangaroo-court arm of the DOJ for political prosecutions, presided over by juries made up of Fed.gov employees and their cronies.
... just kicking the can down the road. The Ds know that PDJT has the R nomination in the bag so all they can now do is pile lawfare on him in the hopes that the voters will get tired of all this crap and vote for someone else next Nov.
What's JR got in his bulging briefcase, at the door of a Maltese bank?
No they cant eliminate it by themselves. They need Senate to confirm it and President to sign it into law.
Unprintable.
“ They wouldn’t take this route unless they knew SCOTUS would quickly take the case and rule against Trump. Bad news, not good.”
They are doing this to keep their ox from being gored when it’s our turn.
“The treasonous Justice who gave us Obongo care...”
I am reminded of the photo of Roberts coming out of that off-shore bank in Malta.
I disagree. This feels more procedural than a major victory.
