Special counsel Jack Smith on Monday asked the Supreme Court to immediately step in to decide whether former President Donald Trump has immunity from prosecution for his actions seeking to overturn the 2020 election.
"This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office," Smith wrote in the court filing.
Smith said it was "of imperative public importance" that the high court decide the question so that Trump's trial, currently scheduled for March, can move forward as quickly as possible.
The Supreme Court decides which cases it hears, so it is not required to take up the case.
NBC News has reached out to Trump's attorneys for comment on the special counsel's filing.
Earlier this month, U.S. District Court Judge Tanya Chutkan, who is presiding over the election interference case, denied Trump's motion to dismiss his indictment on presidential immunity and constitutional grounds, prompting Trump to appeal and ask for the case to be put on hold.
I don't recall Trump ever being convicted in a court of law for any crimes. Maybe I was sick that day.
The SCOTUS could end this nightmare once and for all.

Is this a back door way to keep Trump off the ballot?
Everything is about keeping Trump off that ballot. Everything. They know it’s their only chance.
It could. But what’s the rush? It only proves Jagoff did this purely for political reasons. Taking the standard path will delay his manufactured guilty verdict until after the election.
I have no doubt he would never push to have Trump’s later appeal to go on the fast track.

Jack Smith should not be a special counsel or a council of any kind since he doesn’t know what kind of government the United States has. It is not a democracy. It has never been a democracy. It is not a Democratic Republic.
The United States of America was created as and is a republic.
I actually would be okay with the trade-off because they are never going to have Brandon charged for any crime while he's still living.
Biden’s crimes span 40 years, not just his time as POTATUS.
But they won’t. They will deny this request and force it to the appeals court. They deal with appeals of appeals.

It could, if we had a real Supreme Court. It would say simply that precent gives the President unqualified immunity and not only that but he was already tried and found not guilty by the procedure established in the Constitution - impeachment. Of course such corrupt thugs like Smith, Chutkin and the rest of the democrats don’t believe in the Constitution — especially when it gets in the way of their agenda.
According to the Constitution, only the Senate can after an Impeachment by teh House, Not the Supreme Court.................

Not just biden but a whole slew of others too. Basically what this smith clown is asking SCOTUS to do is render a guilty verdict for Trump for all accused crimes without a trial! SCOTUS should tell the idiot to go pound salt....
