Trump urges Adams, Cuomo to fight ‘unconstitutional’ sex assault suits

Former President Donald Trump urged New York City Mayor Eric Adams and former New York Gov. Andrew Cuomo Wednesday to “fight” a state law that spurred thousands of sexual abuse cases to be filed in the last year — including lawsuits filed against both Democrats last week.

“I hope that Mayor Eric Adam’s [sic], Andrew Cuomo, and all of the others that got sued based on this ridiculous law where someone can be sued decades later, and with no proof, will fight it on being totally unfair and UNCONSTITUTIONAL,” Trump posted on Truth Social early Wednesday morning.

“I got sued, decades later (she has no idea when her made up event took place!), by a woman – I HAD NO IDEA WHO SHE WAS. It was a made up fairytale that was brought and funded by political operatives for purposes of Election Interference.”

He is right.

The law is ex post facto which is completely unconstitutional.

If they want to have a law saying that from now on any sex crimes do not fall under statute of limitations they can do that. It is stupid but they can do it. But they can not just say things that fell under the old laws are now viable again.

Trump is merely pointing out that decades old “sex assault” charges are PURE political tools, meant only to slander the target and generate negative headlines - only for political reasons.

I’m OK with this. Adams and Cuomo are slimy scumbag azzholes, but Trump is right about the constitutionality of this. This allows for so much vindictive activity, with false accusations that can damage an innocent person’s reputation.

When you bring charges against someone, there must be some sort of valid substantiation. Otherwise, yes, this is unconstitutional and dangerous.

Yes, Bill Cosby might be a free man today if we had a statute of limitations, but when sexual assaults occur, women need to report it. Now. Not 25 years later.

I believe Trump is right about the constitutionality of this, but I’m not sure he would win the day in a Federal court challenge.

One interesting precedent was the I-35 bridge collapse in Minneapolis back in 2007. In the aftermath of that incident, the Minnesota legislature retroactively changed the statute of limitations to allow victims to sue the engineering firm that designed the bridge decades earlier. It was an fascinating case because the defendant wasn’t even the original company but a giant conglomerate that had acquired it years before 2007.

In that case, the court specifically said that it didn’t think it was a good idea for a legislature to retroactively change a statute of limitations like that, but it did rule that it was legal for the state government to do so. The court’s rationale was that a statute of limitations (by definition) is a legitimate act of a state government, so a modification of it would be, too.

The Supreme Court ruled centuries ago that the Ex Post Facto Law clause in the Constitution applies only to criminal law. You may not agree with the decision, but it is definitely established law.

I don’t like any of theses cases where they bring up charges from something many years after the fact when there was no report of the crime originally. The courts should have dismissed all of them, regardless of the legislature playing with the statute of limitations.

Allies can be found in the most unexpected places, at least allies on some particular topic or condition.

Now, if Mayor Adams returns the support, he will get clobbered (online) by other Dems. Adams is under so much pressure now, trying to house all those illegals, he may not even care what Dems decide to ‘unfollow him’ online.
Not to mention, he’s not running for office right now, so what they see, is what their going to keep getting, like it or not.

Loser pays would bring the suit as lottery BS madness to an end, that along with the contingency fee scheme. The slip and fall lawyers are among the rats biggest contributors and many elected rats are former trial lawyers. So as a result neither of these will be eliminated ever.
