California Appeal Court Rejects Challenge Against Noncitizen Voting in San Francisco School Board Election

SAN FRANCISCO—The California Court of Appeal issued an opinion on Aug. 8 upholding noncitizen voting in the San Francisco school board election, which allows illegal immigrants to vote.

An extrapolative interpretation of the California Constitution was used in the opinion.

“A United States citizen 18 years of age and resident in this State may vote,” the California Constitution’s Citizen Voter Provision stated.

However, the opinion of the Appeal Court ruled that “neither the plain language of the Constitution nor its history prohibits legislation expanding the electorate to noncitizens.”

The ruling also supports that San Francisco as a charter city has the authorization to make a “home rule” to implement an expansion in local school board elections.

This law ought to be found unconstitutional in the Federal courts, as a usurpation of the power of Congress to establish a uniform rule of naturalization.

Soon it will be illegal for legacy US citizens to vote.

Only non-legacy citizen’s will be considered human.

Insane.

They took the plain language of the state Constitution and turned it upside down.

By defining who MAY vote, the California state constitution also defines who may not.

So since there is not a declarative sentence defining who may not vote, they conclude that the existing sentence is merely declaratory?

Decision first, rationale later.

Right you are. Using that court’s twisted logic, cats, dogs, trees, etc. should also be able to vote. All you’ve got to do is pass the required legislation.

I recall city council meetings when we were protesting millage proposals and the argument was whether or not voters on the millage proposal should be required to be property owners or not.

Now you don’t even have to be a U.S. citizen.

States set their own voting standards for local elections and if they want non citizens to vote for school board or sheriff that is fine. The problem comes when these non citizen registered voters are told by the registrars that in major elections they will get the same ballots as the citizens and if they vote for national candidates it is illegal but, hey, who’s gonna know? O’Keefe has recordings of registrars saying just that.

If the illegal aliens want to vote, they need to go home and vote. They are NOT AMERICANS. They never will be. They might get a government document that says they are a U.S. Citizen. Illegal, but still a citizen. They are not Americans.

US citizens who rent don’t pay property tax. If you say they do through the rent, then so do illegals who rent.
