The first eight amendments limit the Federal Government. They have no legitimacy against the authority of the states.

Impeachment is too kind a fate for her. No agency can create laws per SCOTUS. She can argue all she wants but she knows she has a personal opinion and a profession opinion - neither opinion can stand the test of “Intent” of the law.

Judge Roth makes a strong case, based on Progressive philosophy, the Commerce Clause overrides the Bill of Rights."Progressive philosophy" as a basis for overriding the bill of rights was debunked by our founders long ago...Fortunately, Article 5 of our Constitution doesn't mention crackpot progressive philosophy as being justification for anything. This judge is a disgrace.

His position is analogous to stating that the 2nd amendment would override a newer amendment enacted to repeal it.
