Justices of the Supreme Court of the United States have been on their guard ever since the unprecedented leak of Justice Samuel Alito’s opinion occurred during the court’s deliberations on Roe v. Wade. The leak sparked protests throughout the country, attacks on scores of pro-life centers and faith-based institutions nationwide, and even an assassination attempt against Justice Brett Kavanaugh. Justice Alito said that the leak made the justices “targets for assassination.” “It was a shock because nothing like that had happened in the past,” Alito said of the leak in October. “So it certainly changed the atmosphere at the court for the remainder of last term.”
“The leak also made those of us who were thought to be in the majority, in support of overruling Roe and Casey, targets for assassination because it gave people a rational reason to think they could prevent that from happening by killing one of us,” he added during remarks at The Heritage Foundation. (The Daily Signal is the news outlet of The Heritage Foundation.)
The unrest even led to an assassination attempt against Kavanaugh. Nicholas John Roske, 26, allegedly traveled from California to Maryland and showed up in Kavanaugh’s neighborhood in the early morning hours of June 8. He was armed with a knife, pistol, ammunition, zip ties, pepper spray, duct tape, and other items. He allegedly told police he was intending to use the items to kill the Supreme Court justice, Fox News stated. Roske told police he was upset over the leaked draft opinion on Roe v. Wade and also allegedly said that he believed the justice would loosen gun laws following the mass shooting at an elementary school in Uvalde, Texas. Roske was stopped by U.S. Marshals after he called 911 and admitted he was planning to kill Kavanaugh.
Now on Sunday, the 50th anniversary of the monumental Supreme Court case Roe v. Wade, activists chose to once again harass justices near their homes.
Protests outside the homes of the justices and threats to the justices themselves caused heavy security to be implemented around the SCOTUS, again an unprecedented action. but even with added security, protesters have appeared again. Leftist activists demonstrated unimpeded at the home of Supreme Court Justice Brett Kavanaugh on Sunday evening, Daily Signal reported.
The protesters converged on the sidewalk outside Kavanaugh’s Chevy Chase, Maryland, home. The march appeared to be organized by the far-left group known as Our Rights DC. The group tweeted a poster inviting members to participate in the march within the neighborhoods of Justice Kavanaugh and Chief Justice John Roberts, Fox News reported.
Icy rain drizzled down on the wealthy Maryland neighborhood as about 20 activists, organized by the protest group Our Rights DC, marched up and down the sidewalk in front of Kavanaugh’s home, Daily signal reports. The protesters carried rainbow umbrellas decorated with pro-abortion slogans, singing and chanting as they marched, “cut his time short, a rapist should not rule the court,” “freedom of religion means freedom from yours,” and “no privacy for us, no peace for you.”

A number of U.S. Marshals, who protect the federal courts, were stationed just above the sidewalk on Kavanaugh’s property. The singing and chanting activists processed by the authorities using the sidewalk. The Daily Signal asked the Marshals why they allowed the protesters to continue their demonstrations when 18 U.S. Code § 1507 forbids picketing or parading “in or near a building or residence occupied or used by such judge, juror, witness, or court officer” (both Maryland and Virginia law also prohibit picketing to disrupt or threaten to disrupt that individual’s “tranquility in his home”).
Several of the Marshals, who did not share their names, told The Daily Signal that the activists were not on Kavanaugh’s property, merely the sidewalk, and thus were not violating the code. The Daily Signal pointed out that the language of the code specifically says “in or near,” but the Marshals still said that the activists were within the law since they were on the sidewalk. The authorities also repeatedly mentioned the First Amendment and free speech and said that the activists had the right to demonstrate as long as they were within the law.
Outside Supreme Court Justice John Roberts’ house, at least three Marshals expressed concerns that arresting the leftist activists would have a snowball effect and prompt more activists to descend upon the neighborhood, remembering the unrest that took place during rioting over the death of George Floyd, a black man who died in 2020 after a white Minneapolis police officer knelt on his neck for 9 minutes and 29 seconds. “More and more would come,” one Marshal said. The Marshals also speculated that the pro-abortion protesters hoped to gain attention and notoriety by being arrested — another Marshal suggested that the protestors would enjoy being “martyrs.”
The authorities also expressed the belief that the judges in Washington, D.C., Virginia, and Maryland would toss out any cases brought to them involving the leftist activists who have been protesting at the homes of the Supreme Court justices since May, when the leak occurred.

They obviously were never going to arrest anyone. If I were Kavanaugh or these other justices I would be very concerned for my safety as these “Marshalls” might be inclined to let things happen. They dont seem trustworthy. There are other laws that I think are applicable here such as disturbing the peace. The justices have the right to live in their homes in peace and quiet enjoyment. I’m not buying the Marshall’s argument that this a free speech issue especially coming from the administration that has limited free speech at every turn.

Alito lives in Northern VA. Kavanaugh lives in Chevy Chase MD a wealthy suburban enclave with sidewalks and neighbors. I think a big part of why these Leftists protest there is to annoy his neighbors and turn them against him. They are also very visible in this type of setting which is the point. I don’t know exactly where Alito lives but I saw a picture in the paper that was his neighborhood and his home was more isolated than Chevy Chase so not as easy to harass him or his neighbors or have as many people notice them.
Their argument is ridiculous. The protesters are trying to intimidate and harass a sitting USSC justice. They clearly have orders to do nothing. If I were Kavanaugh, I would be very concerned that these Marshall’s might allow things to get out of hand.
If a conservative protestor showed up in front of one of the leftist SCJ’s home, on the sidewalk, the US Marshals would have them face down, in handcuffs and on the way to jail before you could say Jack Robinson.
Justice is not blind here anymore. It shows favoritism.
However, the police could have gotten more creative. They could have monitored noise levels, written tickets for jaywalking if it occurred, carefully read the laws on public disturbance, parading without a permit, or a host of other infractions.

You have to wade through four paragr⁷¾aphs of conservative rhetoric until you find out what happened. I know that the liberal media does the same, or even worse, but that doesn’t excuse the writer’s desire to write boiler plate rhetoric.
