Judge rules elimination of cash bail in Illinois SAFE-T Act is unconstitutional

A Kankakee County judge has found that a key provision of Illinois’ sweeping criminal justice law is unconstitutional, potentially rolling back a controversial measure that would eliminate the use of cash bail as of New Year’s Day, according to a copy of the judge’s ruling obtained by the Tribune.

The judge’s ruling affects only the pretrial release provisions of the law, known as the SAFE-T ACT, leaving all other measures intact. Judge Thomas Cunnington is expected to file his ruling Thursday morning.

Cunnington’s decision stems from a lawsuit filed by about 60 state’s attorneys across Illinois. The ruling states that Gov. J.B. Pritzker and the Illinois General Assembly violated the separation of powers section of the Illinois Constitution when they pushed through the SAFE-T Act in early 2021 by “by depriving the courts of their inherent authority to administer and control their courtrooms and to set bail.”

A nice ruling. But it’s not like it actually matters. Kim Foxx will still refuse to ask judges to set bail and the endless cycle of slaughter in Chicago will go on unabated.

Oh Yeah. I also remember what is NOT printed on our currency.
Silver Certificate! Redeemable for the face amount in silver.
Now it says Federal Reserve NOTE. Supposedly. In theory. But still better than..........
Now days, a private bank is basically giving you an IOU. Redeemable in politician’s promises.

These laws aren't criminal justice laws they're CRIMINAL SUPPORT laws. Democrat hellhole cities and States want to SUPPORT CRIMINALS and the evil they do against the innocent.

If you read what’s written on the old Federal Reserve Notes, it says “Legal tender... and redeemable in lawful money at any Federal Reserve Bank” The lawful money being gold (before 1933) and silver—or certificates redeemable in gold and silver.

We need to get the Illinois Supreme Court to strike down Lard Butt’s bill as unconstitutional. It’s pretty much the ONLY shot at getting something decent done on a statewide level in Illinois at this point (like when the IL Supreme Court forced the RATS to allow Conceal Carry in Illinois)

I thought it was 3-3 equally divided between the parties (all three Crook County seats being controlled by Chicago and safe RAT of course), with one vacancy because a downstate RAT was defeated for re-election and thus they had open seat in November. If it’s 5-2 RAT, the IL GOP somehow managed to lose TWO downstate seats during the “red wave”. Yup, DEFINITELY a LOT of “Reds” winning Illinois!

Suburban not “downstate”. They redrew the districts (no country splits allowed) for the first time in decades. They probably would have lost both seats (2 competitive races) under the old lines.

I’ll get the numbers later but while I had some hope it was not a surprise they won these seats.
