Florida woman Amanda Ramirez is suing Kraft Heinz Foods Company after her cup of microwavable macaroni and cheese took longer than 3.5 minutes to be fully ready for consumption.

In a class-action lawsuit filed on Nov. 18 in the U.S. District Court in Miami, Ramirez accuses Kraft Heinz of false advertising because her 2.39 ounce cup of Velveeta Shells & Cheese was not "ready in 3½ minutes" as its packaging claimed it would be, the South Florida Sun-Sentinel reported.
The crux of the complaint is that customers are falsely led to believe the product will be ready for consumption 3.5 minutes after the package is opened.
Preparation, however, requires removing the lid, adding water, and stirring in the cheese pouch — on top of the 3.5 minute cook time.
"Consumers seeing ‘ready in 3½ minutes’ will believe it represents the total amount of time it takes to prepare the Product, meaning from the moment it is unopened to the moment it is ready for consumption," the lawsuit states.
The lawsuit goes onto claim Kraft Heinz "sold more of the Product and at higher prices than it would have in the absence of this misconduct, resulting in additional profits at the expense of consumers."
"As a result of the false and misleading representations, the Product is sold at a premium price, approximately no less than $10.99 for eight 2.39 oz cups, excluding tax and sales, higher than similar products, represented in a non-misleading way, and higher than it would be sold for absent the misleading representations and omissions," the lawsuit adds.
The lawsuit further claims that Ramirez would not have purchased the product "had she known the truth" about its preparation time.

I think they call that blanching. Back almost 60 years ago when I worked at McDonalds we precooked our own fresh-cut fries to blanch them and save time on final cooking for sale.
Frivolous as hell, but also a little funny considering John Kerry is a part of this family. If you can’t get to them directly, you go after family.

I thought it was ready to eat 3.5 minutes after you first saw it on the grocery store shelf. Kraft was very misleading in not including time in the shopping cart, checkout time and the ride home from the supermarket. Where do I get my settlement money ????

The blanching step for fries is necessary for the finished fries to be both crisp and fully cooked; it’s not really to save time in the final frying. I worked at McD’s 50 years ago, and it was common to turn 1,000 lb. of fresh potatoes into fries on a busy Saturday.

This jackass’s lawyer should be disbarred. I’ve heard the reasoning and it rests on a flimsy technicality.
Lawyers and morons like this are the reason why we have so many lawsuits in Florida which keeps this state from perfection!

I’ve never seen or tried the product. Tempted to give it a try now. We do not know what the microwave settings have been or the cook times. If it takes 5 minutes in the microwave, then that’s what it should say on the packaging. The distinction between preparing and cooking is not readily ascertained in reading the label. It would be easy to interpret it as 3-1/2 minutes from the time the package is opened.
First of all she cooks mac and cheese out of a box.....it tastes like crap! Get Barilla elbows, cook them for 7 or 8 minutes, have grated American cheese, cream and butter ready and have some REAL macaroni and cheese for your family......good grief!
