DeSantis to face trial for suspension of prosecutor who defied abortion ban law

A Florida prosecutor suspended by Ron DeSantis for defying a new 15-week abortion law says a federal judge’s decision to send his reinstatement appeal to trial means a reckoning is coming for the state’s Republican governor.

Andrew Warren, a Democrat, was removed as Hillsborough county state attorney on 4 August after saying he would not enforce the abortion ban or prosecute providers of gender transition treatment for young people.

DeSantis cited Warren’s alleged “woke agenda” in reasons for his decision.

At a hearing in Tallahassee on Monday, Judge Robert Hinkle denied motions from DeSantis to dismiss Warren’s lawsuit, and another by Warren seeking an immediate return to office, instead requesting their differences be settled at a trial in the coming weeks.

The closely watched case is expected to give clarity to DeSantis’s power to purge elected officials who disagree with him. In recent weeks, the governor has also removed four members of a school board in Broward county that defied him over Covid-19 mask mandates.

seek to destroy whoever leads our cause.

How absurd is this, the governor holding a guy to account
who is not abiding by the law in Florida, and a judge
actually thinks there’s a case against him?

Some of these judges need frontier justice.

The governor did not dismiss Warren simply because he (Warren) disagreed with him. He dismissed the prosecutor because he publicly announced his intention to ignore the law of Florida. There is a vast difference between the two positions.

um... no... it’s as simple as someone REFUSING to do their job and follow the LAW!

he can “disagree with DeSantis” all he wants, as long as he had DONE HIS JOB!

But he refused to do so, and made that refusal public and lost his job because of it. End of story.

Easy decision by any court.

The governor's right to dismiss public officials comes from the Florida Constitution. How is this a federal case? Why did a federal court grant cert when it should have dismissed the case on jurisdictional grounds?

I do like Governor Desantis and you’re right. They’re going to go after him with all the fury that the deep state can muster. The entire federal and half the state governments are going to beat this man into the ground. And then they’re going to ruin his name and cheat him in the elections.

He’d better hold fast!

That goes without saying.

Of course they're going to try to destroy anyone who wins the GOP nomination, whether it's Donald Trump himself or someone they'll quickly label, "Just like Donald Trump, but worse!"

I'm not losing any sleep over this. Ron DeSantis has shown that he's willing to punch back. And I'm certain he was expecting and preparing for exactly this response. The left isn't just going to let us fire their woke prosecutors and Marxist school board officials without a fight.

This DA is going to lose... and lose big. He took an oath to faithfully execute the laws of the state of Florida. You can’t pick & chose. He was derelict.

I suspect the judge simply wants a trial to make that point.
