Aside from the question of whether they have a case, I ask, where can this suit be filed? I doubt it can be filed in Massachusetts. Or even Texas. I think they’d need to file the case in Florida. Good luck with that.

Because of immigration regulations (agency policies on how to enforce the law) - medical tests, background checks, quarantine, etc. Nowadays they call it vetting and detention during that period is Constitutional, as long as the detainee is treated in a Constitutional manner (no Govt. beatings, no Govt.torture, etc.)

As far as the MV illegals, offhand I cannot see where their 14th Amendment rights were violated by anyone. Possibility it could be because they stuck waivers and releases written only in English in front of the people who only read Spanish or whatever foriegn language . That would negate informed consent.

Problem right now is the immigration laws are not being enforced hardly at all.

This whole thing came about from when the Obama DoJ sued Arizona in 2010 over their SB 1070 immigration law that mirrored the federal law.

In blocking SB 1070, US District Court Judge Susan B. Bolton wrote throughout her ruling:

The United States argues that this section is preempted because it will result in the harassment of lawfully present aliens and will burden federal resources and impede federal enforcement and policy priorities...

The United States argues that the influx of requests for immigration status determination directed to the federal government or federally-qualified officials would “impermissibly shift the allocation of federal resources away from federal priorities...”

Thus, an increase in the number of requests for determinations of immigration status, such as is likely to result from the mandatory requirement that Arizona law enforcement officials and agencies check the immigration status of any person who is arrested, will divert resources from the federal government’s other responsibilities and priorities...

Further, the number of requests that will emanate from Arizona as a result of determining the status of every arrestee is likely to impermissibly burden federal resources and redirect federal agencies away from the priorities they have established...

Second, the United States argues that this requirement impermissibly burdens and redirects federal resources away from federally-established priorities...

Federal resources will be taxed and diverted from federal enforcement priorities as a result of the increase in requests for immigration status determination that will flow from Arizona if law enforcement officials are required to verify immigration status whenever, during the course of a lawful stop, detention, or arrest, the law enforcement official has reasonable suspicion of unlawful presence in the United States.

A preliminary injunction would allow the federal government to continue to pursue federal priorities, which is inherently in the public interest, until a final judgment is reached in this case...

Basically, this Obama judge said that it was a federal power to choose to not enforce certain laws in order to focus on other laws, and that states had no authority to force the federal government to follow through on enforcing the laws that the states wanted enforced.

The whole Constitutional order has been flipped upside down. Instead of the federal government coordinating the interests of the several states, the federal government is now choosing the priorities and the states must fall in line or be run over.

Ever since this ruling, the Obama DoJ began a march to ignore the laws that they didn't like and interpret laws in ways that they did like. His crew running the Biden administration is doubling down on this policy.

Now we're even at the point of threatening criminal charges against the Governors of the states who oppose what the federal government is doing.

Yes, this is ridiculous and using this logic one can say the same thing about the hundreds of thousands moved by the Biden administration.

It was also predictable. As soon as the “Sheriff” in Texas opened a criminal case I said the activists would sue DeSantis and Abbott. Did not take long.......

There are two classes of morons in this goat rope. The lawyers are dirtbags who are acting counter productively to the cause of the aliens and they are stoking the fires of bad press for Democrats.

The aliens are almost certainly making a fraudulent claim of asylum and they have guaranteed that their claims will face closer scrutiny and they will probably be deported

No, it does not. But the quote is from the Declaration of Independence, not the Constitution. Most Constitutional guarantees do, in fact, apply to foreigners or sojourners in our domain. Nearly all references to rights are made to ‘people’ not citizens.

My daughter-in-law is a Japanese citizen here with a Green Card. Except for the right to vote and the right to serve on juries, she has virtually all of the rights that I have. Even José, who just scampered across our porous border last night can’t be sent back to Mexico without some sort of hearing (due process) before a judge.

Not liking this fact or agreeing with the Constitutional reasons behind it, does not make it go away. One thing the 14th Amendment did is overturn the Dred Scott ruling that said blacks had no standing in court. Virtually everyone who can get a lawyer can bring legal action—even illegals.

While many who were sent to Martha’s Vineyard were not actually from Mexico, it is interesting to contrast Mexico’s laws regarding foreigners’ rights to ours. If you or I as an American take any kind of part in a political demonstration, we can be jailed or deported in Mexico. Here, illegals can openly march demanding that we change our laws.

Well thats nice and all. Where are MY rights to live in a secure homeland and not have to compete with so many non nationals for living space, jobs etc? Why are we the perpetual dumping ground for those who can’t make it in their own countries or simply believe our government through OUR tax money will pay their way? Why should we work our lives away just for the government to hand it over to foreigners who came over uninvited... and freaking Ukraine?

The population of marthas vineyard is about 12000.
Of the 2,000,000 official illlegals who have entered the usa this year, Martha’s fair share of them, given a usa population of 330 million, is about 72. Desantis didn’t send them enough. They need 22 more.
