(NY) Landlords Would Be Fined $1000 For Checking Tenant Applicant Credit History

A proposal by a New York politician was to fine Landlords $1000 if they check a tenant’s credit history during the application process. The politician believes that credit checks aren’t fair to tenants, however it never occurs to her that it isn’t fair to landlords to not have the opportunity to put the best possible tenants in their property.

that’s with a requirement of credit score over 600 which isn’t much and one year of rental history outside of friends and family.

I don’t know how many applicants are applying with ZERO visible income source. And this is in what was once a bedroom community for Xerox.

The idea is that people will no longer own what is their property. The oligarchs are going to force you to give it up to them through corrupt legislation that will ruin you if you don’t sell to them as a way out. If you already own a home, they will make the property taxes too high and force you out. They are already pulling this stunt on farmers and their land in many countries.

You will own nothing and like it because you will have no choice amerika.

Well, they (That being Obama and his commie buds.) need to find a cheap way to house the army they have brought in through the southern border.. I've heard it's about two million or so military aged men..

Collecting the rent in advance is the easy part. There’s no such thing as an “immediate eviction” in any jurisdiction, as far as I know.

Nope this is NYS. No such thing as immediate eviction. Also you can only charge so much for late charges, rental application fees, security deposit. You have to give the tenant 60-90 days notice of non renewal which too will soon be outlaws as well with the pending “Good Cause Eviction” looming.

I’m retiring from my main gig this November and we are strongly thinking of 1031ing the rental property here into rentals in Alabama instead.

Many politicians have bad credit histories. Look at all the bounced checks in the house and senate. No wonder they want to outlaw checking a prospective tenant’s credit history.

In that case, I’d require the prospective ‘tenant’ pay at least half of the lease period rent IN ADVANCE. OR the tenant can provide me with a copy of their most recent credit report from one of the big three.....

This type of law *increases* rents.

After all, the renters who pay their bills each month would have to subsidize those who don’t.

We shouldn’t fall for the idea that this is a case of renters vs. landlords; the actual contention is between “renters with good credit” vs. “renters with bad credit”.

Their goal is to outlaw SCREENING based on the credit score not necessarily pulling the report itself

That and there is something called “photoshop.” You can get fake credit reports anywhere. I don’t accept any documentation that I can’t personally verify.

Illegal in NYS. the max you can charge per the 2019 rules is $20 per application fee.
