Biden administration: Hospitals 'must' provide abortion services if life of mother is at risk

The Biden administration on Monday told hospitals that they "must" provide abortion services if the life of the mother is at risk, saying federal law on emergency treatment guidelines preempts state laws in jurisdictions that now ban the procedure without any exceptions following the Supreme Court's decision to end a constitutional right to abortion.

The Department of Health and Human Services cited requirements on medical facilities in the Emergency Medical Treatment and Labor Act...

...department said emergency conditions include "ectopic pregnancy, complications of pregnancy loss, or emergent hypertensive disorders, such as preeclampsia with severe features."

...The department says its guidance doesn't reflect new policy, but merely reminds doctors and providers of their existing obligations under federal law.

Simple fix, State law that makes it a felony to lie about an emergency to provide an illegal abortion. Five years for each abortion ( in State prison), loss of license to practice medicine. Fed law cannot trump that. Go ahead doc, use the Federal ruling to perform illegal abortions, the Feds cannot protect you from the State you practice in.

Just think of how many hospital governance boards and attorneys are going to meet over this. A lot of hand wringing and expensive attorney opinions and a WASTE of time and money to satisfy this demented jerk trying to save his political skin.

Not me. I grappled with the rape and incest issues for a long time. I originally was okay with abortion in those instances but eventually realized that the unborn child is deserving of life regardless of its conception.

13% of the population is in favor of a complete ban on all abortions including no exception made for the life of the mother. We have a fairly famous case here in Pennsylvania, our gubernatorial candidate Mastriano favors no exception made for the life if the mother.

Exactly, I think in 2-3 years after things settle down on the Roe v. Wade decision, the number of abortions performed in the USA will likely not change to any great degree.

The hard-core anti-abortion states have succeeded in regulating abortion clinics out of business in many case, I think Mississippi had only 1 abortion clinic in the entire state before Roe was overturned.

Blue states, like California, NY, etc...will make abortion so available the number of abortions will increase and will make up most of the abortions that aren’t performed in other states.

States like Florida, have a trigger law that limits abortions to 15 weeks.

All the Armageddon talk of liberals will be nothing but hot air and lies because abortion will become a non-issue in a few years as most people realize not much changed.

Second time I’ve asked this today, on a completely different subject. Can someone point to me the part of the Constitution that authorizes Congress or the Federal government to have any say in matters of health?

I realize this is a rhetorical question and that apparently that ship sailed a long time ago. But few hospitals straddle state lines so there is nothing ‘interstate’ about them. Yes, FedGov pays a lot of hospital bills, but where in the Constitution is that authorized?

People on both sides overwhelmingly support this exception.
The problem is that liberals in the past have wanted the exception to included the “mental health” of the woman, which opens up a huge loophole.

Include, not restricted to. As I read it, all the reluctant mother need do is claim she's suicidal over the pregnancy and... bingo, abortion on tap.

In a hospital setting, though, there are committees that review physicians’ actions. If the number of therapeutic abortions suddenly increased, the OB/GYN department would have some explaining to do.

I doubt those figures because 30 weeks is the 3rd trimester. We’re talking partial birth abortions and the American public isn’t down with that!
