“And we stand ready to work with other arms of the federal government that seek to use their lawful authorities to protect and preserve access to reproductive care. In particular, the FDA has approved the use of the medication Mifepristone. States may not ban Mifepristone based on disagreement with the FDA’s expert judgment about its safety and efficacy.

“Furthermore, federal agencies may continue to provide reproductive health services to the extent authorized by federal law. And federal employees who carry out their duties by providing such services must be allowed to do so free from the threat of liability. It is the Department’s longstanding position that States generally may not impose criminal or civil liability on federal employees who perform their duties in a manner authorized by federal law. Additionally, the Department’s Office of Legal Counsel has determined that federal employees engaging in such conduct would not violate the Assimilative Crimes Act and could not be prosecuted by the federal government under that law. The Justice Department is prepared to assist agencies in resolving any questions about the scope of their authority to provide reproductive care.

I think this is about rape/incest/life of mother, which federal law expressly permits but some states may not. Garland's point seems to be that the federal government will continue to do that for certain federal employees - military for example - even in states that say no. Legally, he's correct on that as long as it is performed on federal property.

That's my best reading on this, anyway.

I was stumped as to when a federal law was passed instituting abortion.

If I were a provider of liability insurance to Feds I would immediately announce that I am not covering any federal employee who takes orders from the AG to violate an order of the US SC.

The federal govt is no longer authorizing nationwide abortions so it has been remainded back to the States. Garlan has no part in any of this, unless he puts DOJ guards on illegal abortion clinics in certain states.

In fact, Clearance Thomas is going to review many cases where Constitution Law was improperly applied to grant a right and reverse them, one by one.

This is why the Left hates Thomas, he is undoing the Federal Fifedom and returning enforcement to the States on a host of matters, pertaining to prior SCOTUS rulings.

We need to stop allowing the left to refer to abortion and the killing of unborn and to term infants as “womens reproductive health”.

We really can't stop them from saying whatever they want. We shouldn't use their terms ourselves, but they can.

It takes four justices to accept the case for review, and five to form on majority to overturn a prior decision. Clarence Thomas' dissent, though persuasive, was not signed on to by any other justices.

I wouldn't get my hopes up.
