Additionally, the Department’s Office of Legal Counsel has determined that federal employees engaging in such conduct would not violate the Assimilative Crimes Act and could not be prosecuted by the federal government under that law. The Justice Department is prepared to assist agencies in resolving any questions about the scope of their authority to provide reproductive care.

The federal govt is no longer authorizing nationwide abortions so it has been remainded back to the States. Garlan has no part in any of this, unless he puts DOJ guards on illegal abortion clinics in certain states.
In fact, Clearance Thomas is going to review many cases where Constitution Law was improperly applied to grant a right and reverse them, one by one.
This is why the Left hates Thomas, he is undoing the Federal Fifedom and returning enforcement to the States on a host of matters, pertaining to prior SCOTUS rulings.

He is covering himself with “to the extent of federal law.” However, as we saw with the protests at the justice’s houses just how much he respects that law.
Imagine conservatives saying things like this about the Warren or Burger courts and imagine the outrage from Cronkite or Rather or Brinkley and other media and Democrat establishment people from that time.
