Thomas logic appears to be similar to Scalai’s “long standing” defensse of unconstitutional laws, in Heller.
In this case, “consistent with this Nation’s historical tradition of firearm regulation” are acceptable. I don;t know wh the NY law isn;t considered long standing. It’s older than the laws Scalia upheld.

While I do not know the particulars of the case, I suspect the the Dem attorney general was planning to throw the case, the Republicans intervened and his plan went awry.
