Thomas logic appears to be similar to Scalai’s “long standing” defensse of unconstitutional laws, in Heller.

In this case, “consistent with this Nation’s historical tradition of firearm regulation” are acceptable. I don;t know wh the NY law isn;t considered long standing. It’s older than the laws Scalia upheld.

While I do not know the particulars of the case, I suspect the the Dem attorney general was planning to throw the case, the Republicans intervened and his plan went awry.

The remedy for Mirana violation is evidnce is not allowed at trial. The violation does not entitle a person to money damages.

The Court is also handing down decisions tomorrow, but at this point it would seem likely that Dobbs will be held until the final week (if not the final day) of the Term.
