Supreme Court's majority vote to overturn Roe remains intact: Report

The five-vote majority needed in the Supreme Court to overturn Roe v. Wade and Planned Parenthood v. Casey remains intact months after Supreme Court Justice Samuel Alito's leaked draft majority opinion was written, according to a report.

The leaked draft majority opinion penned by Alito is dated February 10 and has almost certainly changed multiple times in the almost three months since it was written, but three conservative sources close to the Court say that the votes supporting the decision remain unchanged, according to reporting from the Washington Post.

The justices set to join Alito's opinion include Clarence Thomas, Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett.

Chief Justice John Roberts, who has at times sided with the liberal wing of the court, still appears set to oppose the decision, with the report noting that Roberts was still attempting to persuade Coney Barrett and Kavanaugh to take a more incremental approach to allowing abortion restrictions.

I agree with the decision, however I’ll say it. It’s a shame this is happening 50 years later when the country has been conditioned to live with the old rules.
And I worry about the effect on elections.
But whatever. And yes of course they should reverse the “gay” marriage ruling as well. Even Roberts voted against that made up decision.

Hopefully, the louder the political protests, the greater the resolve from these five. Fortunately, we don’t have to rely on that wimp Roberts to hold the majority.

Roberts aka obamatard muppet, if everyone remembers threatened the rest of them NOT to overturn the election decision 2006 because “the country might split apart”.

He doesnt have the argument anymore on the other judges, and used his “trump” card. No more surprise Aces’. Quid pro quo. The other judges are already thinking that we gave you backing not to overturn the election, then give us “this”..

I agree with the people who say that they doubt this will have much effect on the election. Too many other things are going on that people feel every day.

Your point being, what, exactly?

This report, said to be from "three conservative sources close to the Court," is consistent with the Wall Street Journal's April 26 opinion piece and, as well, with the Politico article of May 2. That only liberal entities on the Court would leak is an absurd notion. It was Justice Scalia himself who is understood to have spoken directly with Jan Crawford of CBS News after C.J. Roberts' abrupt last minute about face in the first Affordable Care Act case.

Such leaks from the Court are rare, but they do happen. Unfortunately, under Roberts atrocious, self-absorbed "leadership," they seem to be increasing in frequency.

He's a pretty reliable vote for the right side when it loses.

Once the decision is made, John Roberts may join. He prefers 6-3 over 5-4 decision. Also, he may not appreciate being "intimidated" by the Left. Wait and see.

John Roberts should look to Dred Scott and Plessy vs Ferguson. Sometimes you have to overturn “precedent”. Roe vs Wade was a bad decision. Not sure why John Roberts is trying to justify that. If he was on the Supreme Court during Dred Scott, he’ll vote to uphold slavery.

Roberts will split the difference, concur in part only. Uphold the MS law, NOT overturn Roe v. Wade. It is his style.

One exception. IF he joins the majority, he can appoint HIMSELF to write the decision, and maybe water it down. That doesn’t seem to be happening.
