Some gun permit holders would become 'law enforcement' in state's bill

Legislation introduced in the Tennessee state legislature this month is raising alarms from the state's police union and gun control advocates who say it could turn the streets into the "old West."

Two bills in the state assembly and state senate, HB 254 and SB 2523, would amend Tennessee law and designate "a person who has been issued an enhanced handgun carry permit" as a member of law enforcement.

"As introduced, expands the definition of 'law enforcement officer' to include a person who has been issued an enhanced handgun carry permit; provided, that the permit is not suspended, revoked, or expired, for purposes of authority to carry a firearm under certain circumstances," the summary for the bill reads on the Tennessee General Assembly website.

As an attorney for over 25 years, I can say there seems to be a lot more justice found on the streets than in the courtrooms.

How in the world can you look at today’s FBI, ATF and other agencies, and be less worried about them having law enforcement authority than you are about an average American gun owner having it?

No, it doesn’t. Gun ownership is very high here, but we have zero “gun violence.” I have lived in similar areas in Tennessee. Parts of Memphis are already far more dangerous than the “old West.”

I have the enhanced ccw in Idaho. Idaho has constitutional carry. Why have the enhanced CCW? It saves time at the gun shop. No NICS required. Becoming de facto law enforcement isn't on my list of enhanced features. It would have all the liabilities of being a sworn officer without any of the protections e.g. insurance covered by your employer if it was necessary to engage with your firearm. No qualified immunity. No thanks.

State Sen. Joey Hensley, who introduced the state Senate version of the bill, told ABC News that the goal of the bill was to allow enhanced gun permit carriers to carry their weapons into locations where off-duty law enforcement enter, such as a store or restaurant that prohibits guns inside their business. Hensley said the bill would not allow enhanced permit holders to bring their weapons into courts or schools.

Seems like a good idea to me. They are not given the authority of a sworn peace officer, just the same 2nd Amendment rights. Lawful gun owners have proven to be incredibly responsible, so restricting them to the point it's difficult to legally carry a gun without constantly arming and disarming for various stops seems positive.

Despite what is shown on television, there was LESS crime in the “streets of the old west.” Regardless, if muggers, looters, rapists, and shooters were shot on the spot, those activities would stop. It’s called DETERRENCE.

All Tennessee HB 2554 does is allow people with "enhanced" carry permits to carry their firearm in some places that law enforcement officers are allowed to carry.
It does not give any law enforcement authority.

Scottie DeLashmit, the president of Tennessee State Lodge for the Fraternal Order of Police, said police officers in the state “spend countless hours” on the gun range honing their marksmanship skills and must qualify annually with the same weapons.

I’ve seen there training in a county near Nashville.
They practiced drawing there gun in 4 steps, even the faster
guys took about 2 seconds.
I think the average CCW holder practices more and probably
shoots better than most officers.

That sounds like it can quickly maneuver to you have to be a law enforcement officer to have one.
