Pennsylvania Court Says State’s Mail Voting Law Is Unconstitutional
NYT ^ | Jan 29, 2022 | Nick Corasaniti

A state court in Pennsylvania on Friday struck down the state’s landmark election law as unconstitutional, dealing a temporary blow to voting access in one of the nation’s most critical battleground states.

In a 3-to-2 decision, the state court sided with 14 Republican lawmakers who sued last year, arguing that the law was unconstitutional. Pennsylvania filed an appeal to its Supreme Court on Friday afternoon, triggering an automatic stay that keeps the law in place during the appeal process.

The law, known as Act 77, was passed by the Republican-controlled legislature and signed by Gov. Tom Wolf, a Democrat, in 2019. It permitted no-excuse absentee voting, created a permanent mail-in voter list, reduced the voter registration deadline from 30 days to 15 and provided for $90 million in election infrastructure upgrades. It also eliminated straight ticket voting.

The majority opinion, written by Judge Mary Hannah Leavitt, a Republican, said that voting “requires the physical presence of the elector” and ruled that the legislature could not make changes to voting laws without amending the state Constitution......

The bipartisan law was praised by both sides when it was passed, but it became a target of conservatives during the 2020 election, as former President Donald J. Trump unspooled falsehoods and lies about fraud involving mail-in voting. Eleven of the 14 lawmakers who sued to kill the law voted for it in 2019.

Looks like the idiot party (Republican) shot themselves in the foot passing an unconstitutional law and this decision will likely be overturned by the PA Supreme Court and SCOTUS will not take the case.

Most of the political idiocy flows from Rs to Ds, making things appear intentional, to me at least.

President Donald J. Trump unspooled falsehoods and lies about fraud involving mail-in voting.

Opinion presented as fact. The truth is there was large scale cheating, and everyone knows it. No amount of msm gaslighting is going to change that.

Stupid party, indeed. What were they thinking passing that law? What did they think would happen? Freaking idiots.

For those with two brain cells to rub together, it means the framework was installed to facilitate the massive cheating that we witnessed in 2020. More states to follow?

But for voter fraud allowed by “Act 77” Trump wins in a landslide in Pennsylvania.

Is this the legislation from which Coney Barrett recused herself once seated on SCOTUS?

Act 77 was pushed by Democrats and got enough RINOs in the Republican majority to pass it.

Other Republicans sued, the D majority PASC said “No one was harmed yet, come back later”.

The election came and D majority PASC said “Latches. That means too much time has gone by so we won’t even hear the case”.

Taken to SCOTUS, they also declined to hear the case.

The D majority PASC now says yeah, OK, it IS unconstitutional (when forced to hear the case).

The gop wanted straight party voting eliminated. Dems outnumber the gop, so they wanted to be able to peel off votes. Republicans contend that the straight party-ticket option encourages voters to blindly pick parties instead of candidates.

What should be outlawed are ANY party affiliations on all ballots. The two parties are corporations that have been running the country. Make them work for it.

Sounds good until you think about it.

There is some accountability in a party system, You may focus on negatives but look at the whole system.

Look at countries with a multiparty system. IT IS WORSE THAN A TWO PARTY SYSTEM.

When the ballot counters are receiving millions of ballots that they haven’t a clue who mailed them in, I’d have to say that there is a whole bunch of “unconstitutionality” going on in our so called ‘elections’. Definitely a danger to what the ‘RATS like to call “our democracy”.

All of that is true. And, they abuse such concerns. The private/public formation of parties is disturbing. Simply look at gop.gov. That shouldn't exist. A private business, shouldn't be taking up .gov domains, they already have established private domains and connections. Same for dems. BS.

I can’t remember how many mail-in ballots that I received during the election. I NEVER asked for an absentee ballot but I received several mail-in ballots, I’m thinking about 6, so now I’m wondering if I voted six times illegally but only one time in person which was legal. We also have early voting in my state which you still have to show up.

Nobody should be mailing anything to residential households that even simulates a ballot or a registration. Affinity ballots or otherwise.

To me, the total blitz of confusion ballots and/or processes should carry the lawful weight of something akin to counterfitting legal tender.

The only voting and logitics for voting offsite should be a function reserved exclusively for the local registrar’s office. As it used to be.

4 you respond to this thread you should understand what plenary powers are and why they are mentioned in the Constutition.

Plenary prevents the courts' or executive branches' influence on election laws. Elections are political, as opposed to lawful. One exception is the ability of a state governor to supply the slate of electoral college electors if the state legislatures is at an impasse to do so. Courts can only determine if election was UNLAWFUL, and turn it back over to the legislature to work out with Congress.

IANAL, I am not a lawyer. So the courts may exercise other powers to place conditions like successful audits in next election to see if the state keeps its Congressional representation.

Plenary powers means complete power over a particular area with no limitations. Plenary by itself means:

Ok I’ve seen this decision in articles attributed to a Pa state Court and PA state Supreme court. Which is it?

This being a decision by the Pa state Supreme court would be welcome but hard to believe given its leftist makeup.
