Breaking: Judge Rules New York’s Mask Mandate Unconstitutional

The New York State Supreme Court on Monday struck down the Hochul Administration’s statewide mask mandate as unconstitutional and a violation of state law.

Judge Thomas Rademaker of Nassau County wrote in his decision Monday the Governor does not have the authority to impose the mandate and the state legislature would have to debate and approve laws requiring masks in schools and other places.

Last month, Governor Kathy Hochul enacted the mandate amid an increase in COVID-19 cases due to the omicron variant.

It’s a violation of civil Rights, State laws, State Constitutions, the limits of Federal power, and common sense.

Next up, judges will rule on whether or not water is in fact wet.

Correct. Most non New Yorkers and some NYers hear Supreme Court and think a state SCOTUS. In NY that power goes to The Court of Appeals or as it used to be called The Court of Final Appeal.

Bear in mind the NY Supreme Court is a trial court. Their highest court is the Court of Appeals. So, this is just the beginning.

In CT the Governor has allowed cities and towns to mandate masks. Recently with the Omicron Coof several put in mandates, some for the 4 time (including the statewide one). This time, in most businesses, no one enforced it. The sheep complied but if you didn’t 99.9% of places just ignored the mandate and some didn’t even put up signs.
