Woman charged with DUII after hitting, killing man in tent

PORTLAND, Ore. (KOIN) — A woman is facing negligent homicide and DUII charges after she hit and killed a man inside a tent alongside a freeway Sunday in Southeast Portland, according to officials.

The Portland Police Bureau said 27-year-old Terrence Tombe was hit and killed by April Leigh Johnson, 20.

Shortly after 3:20 a.m., officers responded to a report of a crash along I-205 N near the SE Powell Boulevard off-ramp. When they arrived, police said they found a Honda sedan crashed into an occupied tent.

Could attorney argue that the homeless person put himself at risk by camping the freeway grass strip?

I was once in a campground next to a farm. About midnight some idiot drove out of the cornfield and through our campsite. He nicked the tent my infant cousin was sleeping in.

We got a good enough description for the police to track him down.

Since they only charged her with DUI, I suspect they eliminated any manslaughter charges.

Of your impared by alcohol and sitting at a red light and get rear-ended you could and probably will get charged with dui. The fact that you didn’t cause the accident doesn’t matter.

They could argue that.

You can argue anything.

Probably will not work.

A guy built his mail box over spec. Nitwit goes off the road and hits the mail box. Sues guy because it was his mail box that caused him to be injured. Case goes back and forth until the state supreme court (Ohio I think) says "your job is to keep your car on the road. If you do not all the resulting problems are on you."

Real case.

We will see if this state is a sensible.

Probably not.

Her job was to drive the car. Part of driving the car is keeping it on the road. Another part is being in condition to drive the car in such a way you can keep it on the road and not hit things.

She failed on all accounts.

No problem if she's black.

She'll get out on no bail, and when she doesn't show, the coppers and prosecutor will never bother to look for her.

One would also think that not wearing a seatbelt would shift some of the responsibility for one’s injuries from the motorist who struck the injured party to the injured party, but it doesn’t.

Oregon Department of Transportation is criminally liable here.

There are standards for guard rail placement to protect pedestrians (which would include tent dwellers) but a look at Google maps shows there is no guardrail along the exit ramp where the tents are.

The driver may have been Driving Under the Influence (DUI) but would have careened off the guardrail instead of killing a homeless person if the State of Oregon either put in the guardrails required with the tents being allowed or had the State Police remove the tent dwellers.

That is because there are suppose to be no pedestrians.

But nice attempt to save drunken sow who runs over people.

Actually no, it isn't nice.

If the state of Oregon would just hang all drunk drivers perhaps drunken sow would not have been drunk and not lost control of her vehicle.

When you are driving your one job is to drive the car. The basics of that are to keep car on the correct position on the road and not run into things.

It is really quite simple.

I don't even feel comfortable changing my tire by a freeway grass strip. Much less pitching a tent there and spending the night.

Common sense appears to be dead in this country.
