Judge Blocks Biden’s COVID-19 Vaccine Mandate for Federal Contractors

A judge on Tuesday blocked President Joe Biden’s COVID-19 vaccine mandate for federal contractors, finding that Biden likely lacks the authority to force them to get vaccinated.

“This is not a case about whether vaccines are effective. They are. Nor is this a case about whether the government, at some level, and in some circumstances, can require citizens to obtain vaccines. It can,” U.S. District Judge Gregory Van Tatenhove, a George W. Bush nominee, wrote in the 29-page order.

“The question presented here is narrow. Can the president use congressionally delegated authority to manage the federal procurement of goods and services to impose vaccines on the employees of federal contractors and subcontractors? In all likelihood, the answer to that question is no,” he said.

The judge granted a request for a preliminary injunction by the attorneys general of Kentucky, Ohio, and Tennessee.

The White House did not immediately respond to requests for comment.

“This is not about vaccines, it’s about the mandates,” Ohio Attorney General Dave Yost, a Republican, said in a statement. “The judge’s opinion clearly states that and it has been our position all along that the president cannot impose these mandates on the people.”

Biden signed an executive order on Sept. 9 that led several weeks later to the White House requiring contractors force all their workers to get a COVID-19 vaccine unless the worker is entitled to an exception.

Contractors who did not comply with the order, originally set with a Dec. 8 deadline, were poised to lose the government’s business.

The states charged that the vaccine mandate was both illegal and unconstitutional, in part because it was imposed with little regard to “important aspects surrounding the mandate, including but not limited to economic impacts, cost to States, cost to citizens, labor-force and supply-chain disruptions, the current risks of COVID-19, and basic distinctions among workers such as those with natural immunity to COVID-19 and those who work remotely or with limited in-person contacts, among other aspects.”

The government disagreed, arguing that the president does have authority to regulate contractors under the Federal Property and Administrative Services Act because. Courts have ruled the president can pursue “efficient and economic” procurement, which he was in the order, lawyers asserted.

Now if the courts will strike down the same mandates against federal employees and the military, then a huge sigh of relief can be done by all.

I sure hope so. My parent company is a Fed contractor, my division is not. Because we share services and are in the same building, my division has to comply with it. They have said we can’t get medical exemption or make our statement of faith but will have to wear a mask at all times. Because those work /s

I do not see where airlines are affected by this at all.

I guess we could think of this as the (forced) vaccine banned-date.

In the next 4 weeks the world is going to put the load test on the Pfizer/Moderna vaccines.

Singapore in 96% over 12 years old Fully Vaccinated and they are going to try to open to almost Gretchen Whitmer/Gavin Newsom level “openness” /s over the next month.

They have less then 5% Natural Immunity. Will they have Exponential spread with 96% Adult vaccination. I’m betting money on it.

I have one co-worker who already resigned rather than reveal his jab info to the company (Federal contractor). His last day is Jan. 18 (the day of supposed full vaccination if you complied), but perhaps he can take a breather and work longer now.

The airlines thelselves initially said that since they had federal contracts, they had to comply with this.

If this order is not overturned, every contractor who was vaccinated against their will because of fear or losing their job should be compensated.

I don’t have that luxury. But yes, it screams hey I’m not shot up. I wonder if recurring bronchitis due to prolonged masking will fall under workers comp? Maybe I should ask for continued work from home status since I have a good chance of getting it from the shot takers

The vaccines are not effective. It’s really disgusting that even though the judge made the correct decision, most in the legal field are woefully ignorant when it comes to analyzing medical issues. Most in the legal field have very low medical IQs.

1. OSHA mandate for 100+ employees: blocked by courts!

2. Federal contractor/subcontractor mandate: blocked by courts!

3. Healthcare workers mandate: blocked by courts!

4. Federal employees mandate: pending

5. Military mandate: pending

6. Consequences to private companies who discriminated against employees or coerced them to get vaxxed because of fed mandates: pending

7. Consequences to private companies who independently discriminated or coerced: pending

8. Consequences to Pfauci & co.: doubtful

This is shaping up to be a nerve-wracking December and January for private employers who thought the fed mandates provided air cover for them to coerce or fire employees over the vax! Might be time for some companies to start making nice with current and former employees to try and head off the massive litigation and reputation risks.

Dunno if he’s actually shot up; he just doesn’t want to share his vax card. Since I was actually shot up, I went ahead and shared with the company, as required, but it was still obnoxious and intrusive. Don’t plan on taking the booster at this time, though.

My company wanted to be vax-choice, but President Butt-Head took that away from them. If they decided to be vax-choice anyway, no more federal contracts for them, and POOF! they’re gone.
