Rittenhouse, former lawyers in dispute over who gets $2M bond money

The next legal battle for Kyle Rittenhouse may be with his former attorneys.

Two lawyers who briefly worked on Rittenhouse’s case — and helped raise $2 million to help get him released from jail as he awaited criminal charges — want their cash back, but the now acquitted teen’s family is fighting the move.

Rittenhouse was released from jail while he was waiting for his trial in November after a $2 million bond was posted by his former attorney John Pierce, with a cashier’s check from his law firm Pierce Bainbridge. Former child actor Ricky Schroder and My Pillow CEO Mike Lindell were credited with donations that enabled Rittenhouse’s release.

Bond in Wisconsin legally goes back to whoever posted it after the trial is over, which would appear to be Pierce’s law firm.

A second attorney who briefly worked on the case, L. Lin Wood, said the funds were provided by his FightBack Foundation and should be returned to the organization, the Milwaukee Journal Sentinel reported.

In February, the Rittenhouse family fired Pierce, and have since complained that he and Wood diverted money meant to help Rittenhouse.

“I suspect there will be a fight over that,” Rittenhouse’s current attorney, Mark Richards said, according to the Kenosha News. “John Pierce is the person who posted the bond. All that money was raised on behalf of Kyle. Lin Wood and FightBack say they are entitled to it.

“There was half a million dollars I think that came directly from [Kyle’s mother] Wendy Rittenhouse from money she raised,” he continued. “So there’s going to be a fight over that, and I’m just thankful there will be a fight over it.”

Helped raise! Want "their" cash back! I knew these scumbags would try this. It's not their cash. It's Americans who donated and I'd be willing to bet that most are just fine with Kyle keeping it. Give them 10% for their time.

Lin Wood and Peirce did not post the bond with with their own money, so they are not entitled to it.

Wood has no say in the matter. Peirce was acting as legal representative of the foundation that provided the money. His signature is on the check. The money will be returned to him and he will have to return it to Fightback Foundation.

With all the money Wood made from representing Sandnann, why is he risking disbarred by arguing he is entitled to the money that did not come out of his own pocket?

Because Wood is six kinds of crazy. The election showed that if nothing else.

Lin Wood and Pierce are going to lose this case.

Wood yes. Rittenhouse yes. Pierce no. Wisconsin law says the bail money goes back to who signed the check. That's Pierce.

Robert Barnes said he negotiated with Lin Wood to get the money back to Kyle. Whether Wood can be trusted to do that is another thing altogether.

I know noting about bail or bond but it seems to me that that kind of stuff is clearly spelled out in the papers that had to be signed.

It is, as well as by state law. The money goes back to the person who signed the check for the bail money. That is not Wood. That is not Rittenhouse. That's Pierce.

There were MANY small donations to his bail. Very few large ones.

I wouldn't be a bit surprised to see that the actual forms signed when the money was originally given to the lawyer said that the money was "for bail and for other fees associated with defending Rittenhouse or other purposes." and the lawyers will argue that they don't have to give the cash back because of the fine print.

You're right. That money would have been deposited into the Attorney's Trust account in Kyle's name. It does NOT belong to the firm. It's for disposition.

It should go back to that firm...and then to Kyle (since it came on his behalf). Kyle has to and should pay his bills out of it.

They'll figure it out.

However, now that the trial is over I’ve read that Kyle can indeed set up a go fund me account to start to collect all the attorney fees that have racked up.

"GoFundMe" takes a percentage off the top from all donations.

You bet they will want to cash in now that it is safe for them to do so.

It's about the money.

That should be easy to determine...
All contributors to the fund should get their contribution back, IMHO...

Two things:

I’d be really interested to see what the bond amounts were/are for folks charged with murder, both in that county and across the state.

Where did the lawyers get the money? Was it their personal money or did they set up a fund? If it was their personal money they should get it back. If it was raised by the citizenry then it should go back to whoever donated. The purpose of bond is to ensure you show up for court and when you do and the proceedings are over, the money is returned. If the donors don’t want it back, let them decide who it goes to. The lawyers can subtract their rate for the work they did.

With regards to getting a bail bondsman. The 10-12% that you, pay, is a ‘fee for service’ or ‘interest payment’. You’re paying the bonding company to use their money to get you out while you’re waiting for trial. Hence why they have bounty hunters. They put up the whole amount. They get it back when you show up for court. If you don’t show up, they lose their money.

One guy, someone the news did a story on a while back, made a fortune doing it. Black guy that would provide the bond ONLY with some form of collateral, ie..Grandma or momma’s house. The perp skipped, he had no problem taking the house. Needless to say it wasn’t a flattering story but he wasn’t breaking any laws and simply stated that, if Peanut showed up for court his grandma wouldn’t be homeless.
