KENOSHA, Wis. (AP) — The first man shot and killed by Kyle Rittenhouse on the streets of Kenosha was acting “belligerently” that night but did not appear to pose a serious threat to anyone, a witness testified Friday at Rittenhouse’s murder trial.
Jason Lackowski, a former Marine who said he took an AR-15 semi-automatic rifle to Kenosha last year to help protect property during violent protests against racial injustice, said that Joseph Rosenbaum “asked very bluntly to shoot him” and took a few “false steppings ... to entice someone to do something.”
Lackowski got up from the witness stand and demonstrated what he called “false stepping.” He took a small step and slight lurch forward, then stopped.
But Lackowski, who was called as a witness by the prosecution, said he viewed Rosenbaum as a “babbling idiot” and turned his back and ignored him.
His testimony showed a contrast between how the military veteran viewed Rosenbaum and earlier testimony that Rittenhouse — who was 17 at the time — may have perceived Rosenbaum as a threat.

Richie McGinniss, who was recording events on a cellphone that night for the conservative website The Daily Caller, testified that Rosenbaum chased Rittenhouse and was gunned down as he lunged for the young man’s rifle.
“I think it was very clear to me that he was reaching specifically for the weapon,” McGinniss said.

Maybe the reason he didn’t appear to be a threat to this ex marine is that he was unarmed and abnormally small. I mean, downright tiny. 5’ 3” or 4”. That is SHORT for a guy.
And since he was shot “going for Kyle’s gun”, the last thing you wanted was for this guy to be armed.
former Marine? lucky he didn’t get stabbed in the back like the Marines who died in Afghanistan did that fateful day not so long ago.
Act like a rabid animal, expect to be treated like one.

In all seriousness, that’s how I’ve seen it since I found out his height. It explains a lot.
“False-stepping” can reasonably be interpreted by an average person as assaultive aggression. No different than someone throwing a punch that stops 5 inches from your nose.
This guy was a lousy witness, which is why AP is choosing to publish “some” of what he said.

Yeah, he had a little blackout that night. He also seems to have a little CRS condition. Much of what he said contradicts what two other witnesses have said.
If I were a juror, I wouldn’t pay any attention to this guy.
Legal insurrection has some great vids and summaries of the trial. Not going well for the prosecution. After yesterday, I think the defense attorney could ask for a dismissal of the case and get it, as the District Attorney has yet to prove guilt, of any kind.
One of these idiots actually stated he wished he’d killed Kyle.
The defense better get that introduced.
But my money is on a directed verdict of not guilty.

The judge won’t allow the prosecutors to call the assailants “victims” but the AP headline writer makes certain to frame it their way. No surprises here, but it’s something to keep in mind while reading their coverage.
The determination of a threat is based on perspective. A marine would not likely feel threatened in comparison to Kyle.
Also different circumstances. False stepping isn’t the same as chasing and yelling violent threats.
That idiot is still alive; he should be fun on the stand.
