This is blatantly unconstitutional.
In addition, the EUA authorization statute specifically permits any individual to refuse to take any medication that has only EUA approval. Nobody can be forced to take this, not by government edict, nor by employer mandate.
I fully expect numerous lawsuits against this abomination within the next 2-3 business days. No way it survives.

“How long will the ETS be in effect?”
“OSHA anticipates that the ETS will be in effect for six months from the date of publication in the Federal Register. However, OSHA will continue to monitor trends in COVID-19 infections and deaths as more of the workforce and the general population become vaccinated and the pandemic continues to evolve. Where OSHA finds a grave danger from the virus no longer exists for the covered workforce (or some portion thereof), or new information indicates a change in measures is necessary to address the grave danger, OSHA will update the ETS, as appropriate.”
Which translates to as long as they like.
Sounds like a violation of the Nuremberg Code of which the US is a signatory and the Declaration of Helsinki.
In the language OSHA used, claims the “vax” is free, so the testing expense SHALL be forced upon the employee and not the employer.
I'm not so sure about that. Just read a bank-wide email from my CEO at the large bank I work for. They've backed off the vaccine mandate for all employees. Saying more information to follow in the coming days.
7.D. Do I have to provide my employee with paid time off if they are removed from the workplace?
No. This ETS does not require employers to provide paid time off to any employee for removal as a result of a positive COVID-19 test or diagnosis of COVID-19; however, paid time off may be required by other laws, regulations, or collective bargaining agreements or other collectively negotiated agreements. On the other hand, the ETS does not preclude employers from choosing to pay employees for time required for removal under this standard. Additionally, employers should allow their employees to make use of any accrued leave in accordance with the employer’s policies and practices on use of leave. This provision, while not placing the burden on the employer to provide paid time off, should not be read as depriving employees of the benefits they are normally entitled to as part of their employment.

Here is Ohio, fully vaxxed governor The Whiner and his wife are quarantining themselves, despite testing negative, because they were recently in the presence of a Covid positive person.
So what difference does it make if someone is vaxxed? Shouldn’t such a person follow the example of our governor and isolate?
For that matter, shouldn’t vaxxed people also test weekly so that people they were in contact with can be told they tested positive and they need to isolate?
Ohio employees need to argue this with their companies, who need to pressure politicians to pressure Biden to pressure OSHA to write rules that everyone be tested.
Let’s make the hypocrisy and absurdity work for us and just burn the whole damn system down.
