Biden declares, ‘No amendment to Constitution is absolute’ as he rolls out gun measures

President Biden on Thursday announced a slew of new gun control measures after a recent pair of high-profile mass shootings, and insisted the Second Amendment doesn’t grant an absolute right to own guns.

Biden presented the executive actions in the Rose Garden, joined by Attorney General Merrick Garland and Vice President Kamala Harris.

“No amendment to the Constitution is absolute,” Biden maintained, pointing to the famous Supreme Court ruling that you can’t yell fire in a crowded theater as part of the First Amendment’s free speech clause.

"...shall not be infringed" sounds pretty absolute.

Strange that he never mentioned places like Chicago, Baltimore, Compton, etc. I was real strict gun control laws but have huge murder problems.

Remove places like this from the statistics and gun crimes are practically is nonexistent in the United States.

“No right is absolute” simply means “There are no rights”, and that the speaker thinks his word is law.

Of course you can - if there is a fire, or the audience understands there actually isn’t. You’re liable for consequences if you do when there isn’t.

The ruling certainly doesn’t mean the theater can tape your mouth shut just because some other idiot might use their mouth to inappropriately shout “fire!”

The crux of the problem is that the left feels that the state has the power to regulate (take away) any right that they do not agree with. While it is true that no right is absolute, freedoms and the rights of the citizen are to be protected.

The reason for the Constitution is to prevent the “mob rule” that often comes with democracies. To that end, I am of the opinion that any action by the state that attempts to restrict or constrain the free exercise of a right MUST meet the requirements of the legal doctrine strict scrutiny

- there must be a compelling reason for the restrict
a) the government must show a need
b) the need must be specific
c) the need must be acompanied by a legal due process before implementation

- there must not be any other means of meeting the compelling reason

- the restriction must be as limited in severity and duration as possible to satisfy the compelling reason.

To provide an example, convicted prisoners are not allowed to keep and bear arms while in jail. This denial of rights meets all of the above conditions.
