Top-ranking Republicans are trying to stamp out digital vaccine passports, that would allow businesses to check if customers are inoculated against COVID-19.
The White House is working on a private sector-driven initiative to help businesses identify people that have been vaccinated, as venues reopen and travel begins to pick up.
New York has already developed its own version, dubbed the “Excelsior Pass.” The digital app doesn’t display the user’s health information, and will be required for vaccinated customers to gain entry to large venues like Madison Square Garden.

There is absolutely no constitutional foundation for this kind of system. As many have pointed out, this would be an ENORMOUS fist step towards adopting a China-like ‘social credit’ scoring system, a system that allows or disallows certain activities and freedom of movement based on behavior.
The progressives want this in the worst possible way. We’ll see what kind of ‘conservative’ court we have. I’m not hopeful, at all.
I have more confidence in a Covid test than I do for a vaccine. We simply don’t know how long it lasts.

Of course there is. These businesses are private property and it's up to them if they want to only let vaccinated people use their property.
The government's role here, and the purpose of the passport, is simply to help consumers demonstrate that they've been vaccinated if they so choose.
Now, if the government was mandating the vaccination I'd agree with you.

I don't think the plan is for the government to release your vaccination status anyway, just to offer you a way to prove you've been vaccinated if you want to.

HIPAA protects you from everyone but your government.

HIPAA does not provide an express or implied private right of action... Kittel v. Advantage Physical Therapy, No. 19-55690, 2021 U.S. App. LEXIS 1185, at *3 (9th Cir. Jan. 15, 2021).
HIPAA “provides no private right of action.” Webb v. Smart Document Sols., LLC, 499 F.3d 1078, 1081 (9th Cir. 2007).
It is up to the GOVERNMENT to pursue any HIPAA violations. Citizens can file a complaint with HHS, but they can’t file a lawsuit based on a HIPAA claim.
There may be State common law claims regarding the privacy of medical information, but those are distinct and separate from HIPAA and wouldn’t necessarily apply to a situation like this.
I am as against the idea of a “vaccine passport” as anyone. I won’t participate in such a system. However, the people who think HIPAA is a magic talisman here are sorely mistaken.
