Ex-Trump lawyer Powell asks judge to toss voting machine company's $1.3 billion lawsuit

Sidney Powell, a lawyer who advised President Donald Trump’s campaign, asked a judge on Monday to throw out a $1.3 billion lawsuit accusing her of spreading false conspiracy theories about the November presidential election.

Powell said in a filing in federal court in Washington that there was a “no basis” for the lawsuit brought by Dominion Voting Systems Inc in January.

Powell, represented by three lawyers, argued that claims she made about Denver-based Dominion were protected by the right to free speech under the First Amendment of the U.S. Constitution.

She said her claims about Dominion were meant to be hyperbolic, and that “reasonable people would not accept such statements as fact but view them only as claims that await testing by the courts through the adversary process.”

It's possible Q was co-opted by corrupt domestic IC elements who fed them garbage info, and the machine stories were smokescreens to hide the real scam: millions of ballots with unverifiable addresses, bogus signatures, and zero chain-of-custody.

IIRC, not a single court allowed this to go to trial so that Sidney or Lin could present evidence.

I am in a Georgia county as I said upthread which reran the vote count and found that the machines over counted for Biden. My county refused to certify the results, accordingly.

BTW, I don't think all the proposed cases were fraud-based. Some were arguing that certain Secretaries of State had taken action not permitted under current law or the Constitution and that action rendered the election results null and void.

That’s a legal point and a strategy as Rudy didn’t think a court would dig into the issue of any election fraud as that’s the history of most courts.

The time constraints are short and Rudy correctly knew that was not going to work. That was the point he made in Pennsylvania.

Not that there was not major election fraud but that this point would not be tackled by a judge so they used other arguments to focus on the illegality of how the election in PA was run.

Powell is going to have problems with the data.

Take Pennsylvania for an example. Just 14 counties in Pennsylvania used Dominion machines.

In 11 of these Trump INCREASED both his vote total and voting share from 2016.

In all 14 the vote totals went up for President Trump.

In addition to the raw vote increases in EVERY county that used Dominion machines, the percentage of vote increased for Trump in Armstrong, Bedford, Carbon, Clarion, Crawford, Fayette, Fulton, Jefferson, and Warren.

York was basically a wash, and there were slightly decreased percentages in Erie, Luzerne, Pike and Montgomery.

On the Fayetteville County dominion machines Trump won the highest percentage of vote share for a Republican EVER. Biden received the second lowest percentage for a Democrat EVER. Trump netted several thousand more votes over his 2016 share in Fayette County.

So, if the lizard people were rigging the election with Dominion machines, they did a TERRIBLE job in that they actually increased Trump’s margin in PA in these counties that used the machines.

Moreover, they forgot to rig Florida, which also uses Dominion machines and in which Trump vastly overperformed all expectations. Keep in mind that if Biden had won Florida, PA, GA, AZ and WI wouldn’t have mattered at all.

One of the arguments is that they are public figures, but they also said it just wasn't true. Here's the actual defense statement:

More precisely, as part of their defense that it was protected free speech, the attorney's argued that her comments would be understood as political rhetoric, but it's just one point in the argument So, they are arguing that her comments about Dominion were analogous to Trump calling Hillary a crook. That it is all political theater. These are the arguments that lawyers make. You or I may not agree with that point, but it gives a judge a rationale to throw the case out and clear the docket.

The motion to dismiss also raises the issue of personal jurisdiction. If Sidney Powell doesn't live, work or own property in D.C. why is she being sued there? I don't know what Dominion's claim for jurisdiction is based upon. Did the D.C. government ban Dominion voting machines in D.C. because of Powell's comments? This could get thrown out on that point alone. What is troubling is that Dominion filed this case in D.C. because they wanted the judges there to hear the case, and on appeal. To me that suggests that the D.C. federal courts are far too political, like Judge Sullivan. It doesn't bode well for the pending petition for a writ of quo warranto which must be filed there.

That's highly doubtful. For the Dominion machines to cheat, someone at the local level had to permit it, either by allowing the software to be reprogrammed with a USB drive, connecting the machines to the internet and allowing remote access, and/or "adjudicating" ballots on a computer out of view of poll watchers. Not all precincts or jurisdiction permitted the "special features" of the Dominion suite to be used for nefarious purposes.
