The Constitution says that the Chief Justice presides ONLY when the President is being tried. For all other impeachments, normal Senate rules apply.
The Chief Justice presiding is the exception to the rule, not the rule.

If you look at the Belknap arguments you could make one that it relates back to when he was POTUS and thus Roberts should try it.

Maybe a Con lawyer expert on the Senate can chime in and say whether the Senate has the power to designate Roberts (even if he doesn’t want to do it)

From your post I would have guessed that you were in your mid to late 20s but you have been posting since 1998 so you are no spring chicken. It all comes down to the individual and how they age and that is why we have elections where voters get to see their candidate in action. The only way Joe Biden won was because the election was stolen. Nobody would've voted for that senile fool in those unbelievable numbers.
I’m no lawyer, but I thought part of the Democrat goal was to bar Trump from future office. That possible penalty is built into the Constitution, as a potential outcome of a senate trial of a president, presided over by the CJ.
If they recognize that Trump is not president, and if the CJ is not going to preside, then doesn’t this smell even more like a Bill of Attainder where a legislative body votes to punish someone?

Since Donald Trump is not the President, Roberts is off the hook for this kangaroo court of traitors.

As Trump was impeached as the president, he must be tried as the president. The democrats can’s have it both ways, but as usual, they can do whatever they want and the media will put the stamp of approval on it for the great unwashed.

The theory is that Senate is allowed to do it because otherwise people would do what Belknap tried to do..resign and then try to escape the consequences...namely disqualification to hold office.

This being true, the House and Senate are now trying to legally and constitutionally remove President Trump from office.
