Where the president can — and can’t — order Americans to mask up

There are varying schools of thought about whether the president has the authority to issue a national mask mandate, as many other countries have. Some attempts to do so at the state and local level have been met with lawsuits and refusals to comply, as masks have become an increasingly politicized and contentious issue.

Biden has said he will issue an executive order requiring masks to be worn on federal property. Beyond that, Biden’s version of a national mask mandate, as spelled out in his new transition website, does not appear to come from him. Instead, he’s going to be “working with governors and mayors” to encourage them to issue their own mandates, as well as remind Americans to wear masks.

While the majority of America’s governors have issued statewide mandates, 16 states have not — including Mississippi, which revoked its mask mandate in October (Gov. Tate Reeves is requiring masks in certain counties).

Why Biden’s national mask mandate is a national mask suggestion

Because the office of the president does not come with the powers to mandate that all citizens wear masks. The president is the head of the executive branch of the federal government, and the commander in chief of the US military - that's all. He does not have the power to order Americans to follow his whims.

You are forgetting 3 fundamental things about federal government authority since the New Deal replaced constitutional authority:

1. Wickard v Filburn (1942)

The Supreme Court expanded constitutional authority of the federal government from regulating interstate commerce to regulating all commerce and business.

2. Obsolescence of non-delegation doctrine

Regulatory agencies can use the law that set them up to make up any laws they want to regulate business.

3. Fascism

The federal government can and does make up rules that businesses have to follow in enforcing behavior on employees and customers, e.g. smoking prohibitions, or be harassed and put out of business, and states have to impose on citizens, e.g. 21 drinking age, 55 mph speed limit, or lose funding. (The high level of federal income tax makes state self-funding impractical, as well as it being easier to vote down state taxes.)

And there is no shortage of volunteer nannies to report deviations.

Also since the outbreak of the scamdemic the ACLU has been conspicuous by their absence, not even a generic press release reminding elected officials to be mindful of peoples’ CIVIL LIBERTIES when closing “non essential businesses”, issuing stay at home orders and mask mandates. Please show me the better outcomes of states with mask mandates over states without.

You can do the same with nations that have mask mandates versus nations without.

When I look at the numbers, I see no difference in outcomes.

This is all symbolism over substance.
