First of all, the fact that the President, Vice President, and all civil officers can be removed from office by impeachment certainly means that MANY serving officials can be impeached by the House (not just the President). At least 8 Federal judges have been impeached and removed, most recently Alcee Hastings, a judge in Florida who is now serving in Congress (Members of Congress cannot be impeached).

Second of all, although removal from office as a punishment is reserved to the President, Vice President and all civil officers, disqualification from holding office in the future is NOT restricted in this way.

I wouldn’t count on the courts to follow any established law or process. The constitution does not specifically state whether or not an office older can be impeached after they leave that office. Nor does it say that removal from office is the only punishment available in case of conviction.

“Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States; but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.”

The point was being made that only sitting presidents can be impeached.

Um, you also quoted that part that does say that. You can’t remove someone who is already gone.

The constitution isn’t 10,000 pages and lists the entire decision tree. It takes some level of intelligence to discern it meaning.

Look, logically I agree with you. But you are incorrect when writing that the constitution does not explicitly prohibit a post office impeachment. It clearly reads:

“JUDGMENT in Cases of Impeachment shall not extend FURTHER than to removal from Office, and DISQUALIFIICATION to hold and enjoy any Office of honor, Trust or Profit under the United States...”

This simply states the maximum penalty if convicted. Since the latter penalty can still be applied, some legal scholars (and there are some out there who are doing so) argue that this allows a post office impeachment to apply that penalty. The case during President Grant’s administration bolsters their case. Again, I’m not disagreeing with you that in a sane world the possibility of impeachment disappears on January 20. But we are not in a sane world and neither logic nor intelligence apply. Others discernment may vary, especially in cases where it is applied to Donald Trump.

They cannot impeach private citizens. Can they impeach you or me? Think about that. They cannot prevent you or me from running for office by impeaching us to prevent our candidacy.

Legal scholars couldn’t reliably tell me the time of day. I am tired of “experts” being politically motivated and giving bad information.

They impeached the Secretary of War when he was a private citizen.

“Clymer’s committee was informed at 11:00 A.M. of Belknap’s resignation.[86] Although Belknap’s resignation caused great commotion among House members, it did not prevent action by the Clymer committee. The committee unanimously passed resolutions to impeach Belknap and drew up five articles of impeachment to be sent to the Senate. Belknap, by then a private citizen, was impeached by a unanimous vote of the House of Representatives.[87] Speaker of the House Michael C. Kerr wrote to the Senate that Belknap resigned “with intent to evade the proceedings of impeachment against him.”[87] Belknap’s case was constitutionally unprecedented and would serve as reference for nine other civilian officials’ resignations before trial, including President Richard Nixon.[88]”

Biden is NOT going to be President.

IDK if the impeachment will happen or not. But very confident Biden will not be President.

Very doubtful there will be anyone inaugurated on Jan 20. That’s why Trump said he would not be attending the inauguration on the 20th.

all those examples had people who resigned, that would explain all the calls to resign. Trump runs out the clock, he can’t be impeached
