The Michigan appeals court turned down an appeal Friday from President Donald Trump's campaign in a challenge to how absentee ballots were handled in Detroit and other issues.
In a brief order, the court said the lawsuit fails because Michigan's election results, including Joe Biden's 154,000-vote victory over Trump, were certified on Nov. 23, a week before the campaign filed an appellate brief.
The court said the president's only recourse was a recount, but that has passed, too.
“Because plaintiff failed to follow the clear law in Michigan relative to such matters, their action is moot,” Judge Stephen Borrello said in a 2-1 order.
Judge Patrick Meter disagreed, saying a three-judge panel should quickly hear the appeal.
“The issues are not moot because state electors have not yet been seated, the Electoral College has not yet been assembled and Congress has not yet convened to consider whether to exercise its powers under” the constitution, Meter said.

SMH. Hope this is being appealed.
Getting our asses kicked ain’t we? Country is done!
The state legislatures have the power to accept the electors or reject them and seat their own.
Election results cannot be certified when the results are in dispute.
Yes, they do, but they won’t because they are cowards.
Do we have Giuliani to thank for this incompetence?
RE: Election results cannot be certified when the results are in dispute.
But they were in Michigan, so what should the Appeals courts have done? Rule that the certification is invalid?
ALL Republicans are cowards. To hell with them.
Everyone, including our SCOTUS, has been bought off or threatened. Sorry, but I have to laugh at people putting their hopes in our SCOTUS in the long game with this election fraud!
I’m putting as much faith in our SCOTUS as I have in the DoJ, FBI, and other government agencies!
I’ve known since shortly after election night how this would turn out, and I didn’t even have to come to FR to know how this was going to end.
This was lost when Gulianni’s hair dye melted. It didn’t matter what he said after that. The press and left were laughing to hard to hear or care.
Until the results are certified, there isn’t an official result to contest.
that judge is either corrupt or retarded. Or both.
This is a Michigan court of appeals, ruling on Michigan law. It can be appealed to Michigan Supreme Court, but not to SCOTUS.
Pardon me, and I don’t mean to offend, and if I do, please attribute it to the scotch I had earlier.
But ... here goes:
I blame Rudy. After losing in the trial court, he filed a defective appeal, missing the required paperwork. The appeal was rejected, and by the time he crossed his t’s ad dotted his i’s and submitted a proper appeal, it was too late.
As I said earlier, you do not wait to test your parachute after you jump out of the airplane.
DJT had been warning us for MONTHS about election fraud. And Rudy, as DJT’s PERSONAL lawyer, should have been orchestrating this.
We should have had teams of skilled litigators available, on standby, in each and EVERY contested state.
Yeah...he should have known better than to be so vain to dye his hair with something that would melt. AWFUL.
But the facts are the fact - this election is being stolen right in plain view.
I guess that theft of an election is different from other thefts?
So, if someone robs a bank, and spends the money before he is caught... it’s too late to do anything about it?
Never mind that theft of an election is millions of times a greater crime than ‘just’ robbing a bank.
There should never be any kind of ‘statue of limitation’ when it comes to stealing an election.
It’s too late. The criminals have already stolen your property. If you had filed suit against them before the crime you would have recourse. Now you have no standing.
This is insanity.
This is a nonsense ruling. The state of Florida certified it’s results in 2000 election, and the court cases kept going on and on like it never happened. In fact, Gore kept winning them all.
So you think President Trump is a coward ?!?
No, do not think so. We have those in Michigan who went ahead with certification when they should have said “no.” Glad it was not me, but was less than brave on their parts.
