They have already stated they have not segregated the ballots after the Supreme Court told them to do so the first time. And how, once they are blended in, can they be recognized?

Their enforcement ability depends on what argument is brought to them.

I've been saying that if the state legislature brings the argument that it is they who have the Constitutional authority to make election law, and not the elections officials, the governor, or the state courts, and that the election is so corrupted by their unconstitutional power grab as to be beyond trustworthy, then the only option for the court is to nullify the certification and let the legislature exercise its Article II Section 1 power to select the electors directly.

The way to do it is this:

1. Hold the recanvas and document the inconsistencies in the books.
2. Prove that it is systemic and not just a statistical anomaly. Name names of perpetrators and provide whistleblower testimony, if possible.
3. Argue in front of the Supreme Court that the Constitution provides for the remedy of the state legislature, acting as the representative of the people in a republic, to select the Electors in a failsafe situation, as long as the Court finds the management of the election to be so fraudulent and untrustworthy as to vote to decertify it.
4. Then have the GOP state legislatures meet to vote on the following:
   • Have their GOP legislature make a vote of no confidence in the outcome of the election, citing a) widespread non-compliance with the election laws as passed by the legislature, and b) numerous examples suspicious behavior in the counting of the votes.
   • Have a second vote to express the sentiment of the legislature that the people of their state intended to vote for President Trump.
   • Have a third vote to exercise their Article II Section 1 power to appoint the Trump slate of electors to the Electoral College.

Then let Biden take THAT to the Supreme Court.

If they don’t like it, take it up with local the election officials who caused their votes to be disqualified.

Possible additional expense. Just outside the elections office leave a goodly supply of tar and feathers. May be a bit expensive but it will be worth it.

By the time SCOTUS rules on this, the elections officials will say “Sorry, we accidentally comingled those ballots into the general mix and can’t back them out from the counts anymore. The intern who made this mistake has been reprimanded with a sternly worded letter in his permanent file.”

Well, that is not going to work. The Secretary of State Kathy Boockvar sent an email to all the poll workers telling them not to separate the ballots. At least, that’s what the PA legislators said when they called for her to resign.

What’s the remedy if PA has made certain that those ballots cannot be segregated?

Simple. Invalidate the election and make only those who voted on election day vote again. Or else award it to the person who was leading on election night.

Well, then she's in contempt of court and can be used as prima facia evidence of vote fraud.

That's all that SCOTUS would need to set aside the certification of the election and hand the remedy to the legislature via Article II Section 1.
