Democrats shoot down talk of expanding Supreme Court

Senate Democrats are tamping down talk of expanding the Supreme Court if Republicans fill the seat held by the late Justice Ruth Bader Ginsburg.

Progressive activists and some lawmakers have raised the idea since Ginsburg's death was announced on Friday night, arguing the party needs to be ready to take bold steps if they have the Senate majority and the White House next year while facing a 6-3 conservative court.

The effort would tie together two controversial ideas: nixing the 60-vote legislative filibuster and then passing legislation to add seats to the Supreme Court, which has been set at nine justices since 1869. But several Democratic senators, including senior members of the caucus, are shooting down the idea altogether or warning that debating it now is a distraction from the fight over Ginsburg's seat.

They figured out that by threatening to expand the court could also be done by the republicans if they maintain control of the Senate and WH.

i think a law limiting the court to 9 would be in order...

Maybe the idea of expanding Supreme Court isn’t polling well? Maybe some people on the Democratic side are concerned that the American people are getting the idea the Democrats are a bunch of lunatic radicals for even bringing up this subject?

That’d be great, a non-stop fight over the Court even when there are zero vacancies. The Democrats expand it to eleven to shove through two more Democrat-appointed Justices, the GOP will probably end up expanding it to thirteen and doing the same as soon as they hold the Senate and White House again, and on and on and on.

Any law that can be made, can be changed. A constitutional amemdment is needed. Not much chance that could happen under current or forseeable conditions.

Yeah. These goofy communists are the sharpest tools in the political shed. Not only could the republicans do it if they maintain control, they could give the communists exactly what they want....and do it right now!!!

Already exists. See the Judicial Act of 1869.

A Constitutional Amendment, OTOH, would be better.
