Democratic presidential nominee Joe Biden admitted that while he believes that he would have the legal authority as president to implement a nationwide mask mandate, he “can’t guarantee you that yet.”
Speaking to reporters Wednesday in Wilmington, Del., the former vice president remarked that “there is a question” that he believed “can be answered in the positive” over “whether I can mandate over state lines that every single state has to comply.”
Biden made the comments after being asked by a CNN reporter how he would implement a national mask mandate.
“Our legal team thinks I can do that, based upon the degree to which there’s a crisis in those states, and how bad things are for the country,” Biden said, later adding, “I would make the case — I’d make the case why it’s necessary. I’d have the scientists arrayed to lay out in detail why. And I would go to every governor … Republican and Democratic governors and I’d say we have to have this national mandate. We must do it.”
The reporter then pressed the 2020 Democrat, asking how he would manage pushback from Republican governors.
“Well the question is whether I have the legal authority as president to sign an executive order. We think we do but I don’t — I can’t guarantee you that yet,” the Democratic presidential hopeful responded.
Earlier this month, Biden appeared to walk back his mid-August call for an immediate, three-month-long nationwide mask mandate, something he originally argued would save about 40,000 lives.
During an interview with AZFamily’s “Politics Unplugged” in early September, Biden was questioned about his repeated pledges to use the powers of the presidency to force Americans to wear masks..

I guess if you think gun-grabbing is Constitutional - even with an explicitly stated prohibition of it written in the Constitution’s very words - them mask mandates can be nothing but “Necessary and Proper.”

We’re being set up. Conservatives and people who support the police are generally very law abiding. But what happens when the government starts using the police - who just do as they are ordered, after all - to enforce this mask mandate on us?
Next....did you change your underwear today? Brush your teeth twice? Eat healthy meals? Drink enough liquid? Hope middle America sees where this will go...
The Constitution is only an impediment for conservatives, so he’s probably “right” about this in the end. Ginsburg, Kagan, Breyer, and the Wise Latina will agree with him. Anyone on the conservative side have a “compromised immune system?” I think 5-4 allows him to do whatever “he” wants.
The party that supports defunding the police wants BLM to enforce a mask mandate.
If there was a nightmare scenario pandemic with millions of people dropping like flies, I don’t think there would be any constitutional objection to laws restricting spread. It is protecting the population from a very deadly enemy. And people flouting the laws are akin to traitors helping a deadly enemy travel during wartime.
The real question is at what point is a pandemic “deadly enough” to warrant such a response. And how early must laws be in place if we see a potential pandemic clearly on the horizon.
This is all subjective and can be debated until the cows come home

...saw a couple of contributors on Tucker Carlson last night - basically, masks are USELESS in preventing that COVID virus from getting to you...I have seen this coming from other medical professionals as well... when are the authorities [sic] going to tell us to stop wearing these damned, useless face diapers....some day, the sheeple will rise up...
So if I cross state lines while not wearing a mask I go to Federal prison for 15 years.

It's already been 6 months, one would think these "scientists" would have already laid out the facts, science, and data proving masks are totally effective. The fact that this has not occurred, in 6 months, tells me they are not that effective and you'd be better off simply avoiding very crowded areas.
He needs a new legal team. He can’t do a national mask mandate.
Notice that President Trump asks people to do things like flatten the curve.
