A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn.
A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

The one judge that dissented can ask for a full court...AND the DEM appointees are easily in the majority.
You’re referring to an en banc decision by all DC Circuit Judges. One judge cannot trigger that. It would have to come from a party (i.e. Flynn or the US DOJ.)

I am going to go out on a limb here and predict that absolutely no one will go to jail under over this. People keep saying have patience and don't seem to realize that Trump has 6 months remaining with no guarantee of a second term, not because he doesn't deserve one but be ouse thee is serious plans for stealing this election and this country, next the New World Order. ..
How many times have you been wrong standing by what you said? There will be an en banc hearing and it will reverse the circuit court. SCOTUS will then decline to intervene, leaving Flynn back it Sullivan’s court. It’s scripted, by the 2-1 decision. Wilkins teed it up for more delay with his dissent.

Good take. Sullivan's removal of the July hearing is of no meaningful consequence; at the last minute, he will ask the full court to take the issue or otherwise has been told it will. The full court will continue to run out the clock with its view of what the words, "with leave of the court" plainly means in this particular factual setting.
IMO, however, the law is so strong the USSC will almost certainly intervene; and, under Roberts, we may see a subtle attempt to further delay resolution beyond the presidential election.
