Appeals court orders judge to dismiss Flynn charges

A federal appeals court on Wednesday ordered a judge to grant the Department of Justice's (DOJ) unusual move to drop charges against former national security adviser Michael Flynn.

A three-judge panel on the D.C. Circuit Court of Appeals approved Flynn's petition to intervene in the case after a district court judge had tapped an outside counsel to argue against the DOJ's move.

The Obama appointee (Wilkins) voted against it on procedural grounds. He said that Sullivan deserved his chance to “explore” the issues.

The judge appointed by the man who believes the Constitution is a "negative rights" document declares that the right of a judge to "explore" issues overrides the 6th amendment right of the accused to a speedy trial.

The Court agreed Barr was legally correct, so he must resign?

The other judge was an H.W. Bush appointee so her “Trump judge” comment doesn’t hold water.

Here is the link to the decision. The majority “bench slapped” Sullivan, but that was nothing compared to the humiliation the majority gave to Wilkins, the dissenting Judge. It’s just brutal. Well worth reading for that reason alone.

I’d take the dog in the middle, looks like a Labradoodle. I can’t get a good look at the dog on the left. And the bitch on the right is obviously to needy, and will always be seeking attention.

As someone has pointed out, appeals have been filed in similar cases, but the Appeals Court decision anticipated this and was quite clear about the way ahead. The decision boxes in the Judge and by denying the motion to replace Judge Sullivan, they have given him an out if he behaves. He can go back to his cozy life and pretend that he is impartial.

Sullivan tries to keep that July 12th hearing date Sidney
will have to appeal to Roberts to take Sullivan off the case and end this sham.

Exactly. As a practical matter, the clock still has time left on it and it is a race to the presidential election.

In lieu of removing Sullivan, Roberts might direct a hearing of the full court = more delay. To the extent the "fix is in" re Flynn, the full court could find against Flynn. That, IMO, is why the majority opinion was ruthless with the dissent's reasoning - to let the full court know what could be coming its way, with the hope cooler heads will prevail.

With an adverse full court decision, however, Flynn would have to go to the USSC and confront Roberts yet again. More time and money.

I imagine Flynn's legal team will enjoy a large portion of any book profits he earns; I will certain buy the book.

Who cares if he’s an attorney. If obama can be pres and Sullivan can be judge jury investigator prosecuting attorney and executioner I think General Flynn would make a fine US AG wouldn’t you agree?
