, the Ninth Circuit reversed the decision, not based on arguments presented by Sineneng-Smith, but by third parties the court brought in to submit arguments that the panel of judges themselves had suggested. You just can't make this sh*t up.

More like, 2 Clinton appointees and 1 Obama appointee on the 9th schemed a way to overturn McCarran-Walter but latched onto a bad case in an attempt to stuff the hoop, then figuratively hired the Lakers to stuff the hoop for the Defendant, ignoring the axiom that 'Bad cases make bad law'.
It's kind of incredulous radical court activism really, but look at the Judge's backgrounds and you can see how it happened.
The best part may be the penultimate graf in this report where Sineneng-Smith's SCOTUS counsel whined about his rare 9-0 slapdown like a stuck pig.
