New Orleans Mayor Issues Coronavirus Order Allowing Ban on Sale, Transportation of Firearms

New Orleans Mayor LaToya Cantrell (D) signed a coronavirus emergency order last week allowing her to ban the sale and transportation of firearms.

She signed a follow-up proclamation on March 16, 2020, further emphasizing her emergency powers to “suspend or limit the sale, dispensing, or transportation, of alcoholic beverages.”

The declaration declaring the mayor’s power to restrict gun sales and transportation says she is “empowered, if necessary, to suspend or limit the sale of alcoholic beverages, firearms, explosives, and combustibles.”

On March 16, 2020, the Second Amendment Foundation responded to Cantrell’s claims of emergency powers over firearms by reminding her that they sued over Second Amendment infringement following Hurricane Katrina and will do so during the era of coronavirus if needed.

It goes without saying she does not have the legal authority to do that. Not that that matters to Democrat politicians.

I’m with those who think some of these so-called executive actions by mayors and governors are, amongst other things, a dry run to see how the populace reacts.

I think the mayor of Louisville, Greg Fischer, is capable of trying this, Louisville being an extremely liberal city. I don’t think, as much as I detest the man, that Andy Beshear has got the balls to do it for the state. I can guarantee the little town I live in the cops wouldn’t be banging on the doors looking for your guns. They’re not that stupid.

New Orleans took peoples guns away from them after Katrina. Banning the sale of alcohol will go over worse than guns. New Orleans is a drinking city and not being able to get their cocktails will drive people crazy. She’s a stupid bitch. Now if the governor tried to ban guns like that there would be a big big problem with the rednecks.

Yep. The law that was passed in response to New Orleans' last transgression on this topic is worded specifically enough that it doesn't address denial of sale of new firearms. Latoya isn't smart enough to know that, so this action is being orchestrated by the democrat hive mind - just like in 2005-6 with Blanco and Nagin. You could see Mary Landrieu in those press conferences, standing off to the side, practically mouthing the script that Blanco was supposed to recite.

Happens all of the time when there is a natural disaster or some major event.
These same people support the elimination of the 2nd amendment and then wonder why they can't purchase a firearm when they need it. Let's face it, people are dumb. I wonder how many of these new gun owners are Democrats who support elimination and confiscation? At minimum they might learn a bit about the process and the fact that the process for purchasing a firearm isn't as easy as Democrats claim.

What is with the government in New Orleans and Louisiana. They did the same thing after Hurricane Katrina. There are lots of legitimate things to do when facing a serious epidemic. Restricting the 2nd Amendment rights of Americans isn't one of them.

And banning the sale of alcoholic beverages is also a ridiculous idea.

What a moronic Mayor.

In her proclamation, she said:

"Subject to the provisions of Act 275 of 2006 (Regular Session), the Emergency Authority is hereby emowered, if necessary, to suspend or limit the sale, dispensing, or transporting of alcoholic beverages, firearms, explosive, and combustibles."

Well, Act 275 of 2006 (Regular Session) says:

"(1) Nothing in this Section shall authorize the seizure or confiscation of any firearm or ammunition from any individual who is lawfully carrying or possessing the firearm or ammunition except as provided in Paragraph (2) of this Subsection.

(2) A peace officer who is acting in the lawful discharge of the officer's official duties may disarm an individual if the officer reasonably believes it is immediately necessary for the protection of the officer or another individual. The peace officer shall return the firearm to the individual before discharging that individual unless the officer arrests that individual for engaging in criminal activity, or seizes the firearm as evidence pursuant to an investigation for the commission of a crime."

She doesn't have the legal authority to ban the possession or transportation of weapons during a declared emergency, and her lawyers who drafted the proclamation knows it.
