Judge Napolitano calls Weinstein verdict a 'monumental setback' for government

Fox News senior judicial analyst Judge Andrew Napolitano reacted to the Harvey Weinstein verdict on “America’s Newsroom” Monday, calling it a "significant victory" for the disgraced movie producer and a "monumental setback" for prosecutors.

Weinstein, 67, was convicted of first-degree commission of a criminal sexual act and third-degree rape but was acquitted of two more serious charges of predatory sexual assault, as well as first-degree rape. The charges Weinstein was convicted of carry a total sentence of up to 29 years in prison.

“He’s still facing serious time," Napolitano said. "But, these are not the life sentences, the big ones the government wanted."

Basically, the women were very highly-paid hookers. Going forward, as long as directors pay aspiring actresses in cash not exceeding typical hooker pay scales, they should be A-OK. I am diametrically opposed to both Weinstein’s politics and lifestyle, but this prosecution is just nuts, taking #MeToo and #BelieveHer to its illogical conclusion.

Not sure what you're asking. What? Some clueless starlet wannabe lays on Weinstein's casting couch is a predator? Big difference in being stupid with no morals and a big fat ass movie mogul taking advantage of the idiot woman. I would bet 10-1 that older mature actresses did him too. Parts are parts in Hollywood.

Have you seen his wife - now estranged? She’s gorgeous and I can’t imagine why she married that fat creep. She wasn’t exactly poor and she has a clothing line, Marchesa. I know Harvey made a lot of the stars wear Georgina’s clothes I would have thought they could be chosen on their own merit.

There are some decent people in Hollywood, probably a lot. What percentage of the movie crowd they comprise, I don't know. There are even a few Republicans, though a lot of the pubbies call themselves libertarian as a kind of camouflage. That said, I don't see many movies and don't follow the business, but I do have a question on this score.

Given the lifestyle insanity, the cultural rot and the political bigotry on display in the movie industry, are there any major producers/studios who have deliberately stepped back and drawn a firm line? I know that there have been a few explicitly Christian ventures that have done this, but these seem to be minor players. From the occasional film of theirs that I've seen, they also seem to be a bit too obviously preachy and formulaic to break through to the majors. (I hope that will change.) But what I have in mind is a major producer or studio that makes it very clear to all employees and prospective actors that anyone who brings sex or drugs into the workplace will be out the door immediately. "What you do on your own time is your own business, but keep it out of the office and off the set." I would think a no tolerance policy would have a real appeal for a lot of people who want to work in the industry without selling out.

Here and there, I do see interviews with actresses who are very outspoken about refusing to do nudity and explicit sex scenes. The men are obviously under less pressure in this area, as prostituting the women is what Hollywood reflexively does, but a few of the men have spoken out as well. There are many more who seem to have avoided onscreen sexploitation, and I wonder about the behind the scenes discussions involved with that. I also think that at least some producers and directors must understand that less can be more when it comes to explicit sex in movies; restraint, decent behavior and leaving the steamy details to viewers' imaginations makes characters infinitely more attractive. I wish more people would speak out, but I do wonder if there isn't a self-conscious counterculture in Hollywood pushing back on this.

Actors are in a very weak position because if you refuse to do X (on or off screen), you know that there are a hundred others lined up who would jump at the chance. But producers and directors are immune from that pressure. Surely at least some of them go into each picture thinking, "I'm going to protect that young actress as long as she's here." It occurs to me that a lot more women directors might be part of the solution.

I watched about half hour of the trial. Listened to the bimbo who said she was raped, then had parties, then kept calling Weinstein so that she may further her career...

'nugh said. Everyone knew about the casting couch. Everyone. Even those who weren't in the business. The bimbos are making millions now because they swapped dna with the dude. Now they're attacking the guy that made them filthy rich?!! Maybe they should return the money before they complain about their "audition".

Real rape victims don't have a choice about the couch. It just happens, unexpectedly. They don't get compensated with furthering their careers.

I, seriously was hoping he would get off scott free :)

BTW, I'm a female.

The fact that the judge refused to continue his bail and remanded him indicates that he won’t be considering leniency. He won’t get the full 29 years. Maybe half that, but at Weinstein’s age, it might as well be life.

Agree on that. And I am not a fan of digging up something from many years ago with no proof.

If these women in all these cases think they were assaulted then they need to say so at the time.

Nap is just too full of himself. It’s hard enough to win a good solid rape cash with a willing victim, good evidence, and no time lag in reporting. This case was difficult for a number of reasons.

At the time the assaults happened, the priority of the women was to land the big roles, so they did what they had to do. Now that they’re has-beens, it’s convenient to drag out ancient history.

Weinstein is worse than scum, and the word is that everyone knew it. Decades ago I read a book in Dad’s library by an evangelist we knew, Bob Sumner, “Hollywood Cesspool”. It’s always been a horrid place, and I expect it always will be.

Weinstein might now be under a lot of pressure to snitch on everything and everyone he knows. And Weinstein probably knows a lot. You think he didn't supply "VIPs" with pretty starlets on request, in exchange for important favors?

The prosecutors better do a better job of protecting him than the did Epstein.
